An investigation from the Indiana Attorney General has determined this company is in violation of the Indiana Home Improvement Contracts Act, Code
24-5-11-1 through -14; the Indiana Deceptive Consumer Sales Act, Indiana Code 24-5-0.5-1 through -12; the Marion County Municiple Code 24-5-11-9 and the Indiana Deceptive Consumer Sales Act, Indiana Code 24-5-0.5-10. There is a letter from the Attorney which states that LeafGuard may be in violation of a Breach of Contract and Poor Workmanship.
The Indiana Attorney General has chosen not to take action at this time because of a lack of consumer complaints, but warns this company against any further reports.
LeafGuard has taken this response from the Attorney General and decided that since the Attorney General is not taking action against them they are under no obligation to improve on their business tactics or do anything to improve the relationship with their customers, or the faulty product they sell.
The fact that the Attorney General has not taken action does not forgive the violations of the LeafGuard company or the product they sell. My complaint against LeafGuard remains without resolve. The LeafGuard gutters do not work on this house and LeafGuard refuses to remove them and refund us our money. I was told a law suit would only benefit the Attorney. We were told the media and letters such as this would be the worst thing for this company.
We can only hope. I have never done business with a company that does not care about their customers, customer satisfaction, or make it a company policy.

We ahd the leaf guard system put in last year and ahve no complaints. They work great and do exactly waht theya re supposed to do. In fact, the installers put in 2 extra down spouts and we do not avhe the water probelm that we did have. Maybe it is just that I live in washington State, and they care here. Also I want to know how it is leaf gurads fault taht you have mould in your basement?

I tried to Arbitrate with this company but the BBB ruled in favor of the paying member. I have invested $6,800.00 plus was quoted $750.00 to clean up the mold problem in the basement. Leaf Guard thinks they are out of the woods because the Attorney General has not taken action and the BBB voted in their favor. Angie's List has now started collecting reports about Leaf Guard. I hope an Attorney does contact me I would love to have a class action law suit filed against this company. I hope no-one gets into this mess like I did. The other motivation that I had was an 85 year old woman who was forced to settle out of court with Leaf Guard and then was forced to sign a "GAG" order and never speak of this again. This is dispicable who do these people think they are.

Since I filed my first report in 2007 I reported this information to the BBB, which Leaf Guard is a memeber of. We are now having MOLD problems in our basement and had this confirmed by a Mold & Radon Inspector that is also a memeber of the BBB. My complaint with this company is the fact that they are in violation of almost every code set out by the Attorney General of the State of Indiana, for home improvement contractors. Plus the product they sell is a scam according to an Attorney I spoke to.
Some of the parts they install are pre-fabricated and by their own admission are not part of the Leaf Guard Gutter system. These items do not appear on the video we were given or in the brochure that was left by the salesman. These gutters leak and are causing damage to my house.
Further more the BBB is not protecting the community by ruling on behalf of the consumer they ruled in favor of their member. I have lost over $6,000.00 plus $750.00 for the clean up of the mold from this company.
Leaf Guard still refuses to come and remove this product from my home and allow me to replace it with gutters that will really work. The proposal they made would cost me more money to have them replaced. Leaf Guard also claims that due to a hail storm we had my gutters were damaged and do not function properly. The hail did not change the valley in the roof and the overshooting of water when it rains, and the leaky corners that have caused the mold to form in the basement.
I have now filed this report and a report with Angie's List. If the Attorney General of the State of Indiana gets enough consumer complaints they will take action against this company.
