Magisterial District Court MDJ-23-3-09

Docket MJ-23309-CV-0000099-2015

Judgment won against Lee Myles Transmission Autocare for $3,152.00, plus $188.75 in filing fees, and won $500 in attorney fees.

Complaint:  "On June 1st(2015) I made a contract(see invoice) with the defendant for the rebuilt/overhaul of the transmission for my 202 Ford Explorer 4WD.  The total cost for the jon was $2,300.00.  I was required a deposit of $1000.00 and the balance was due when work is completed.  Mr. Martella told me that it was going to take them 4 days and I should be getting my SUV by that Friday the 5th.  On Thursday the 4th he called me to inform me of delay on the job but he assured me that it was going to be ready by the next Tuesday.  On Monday when I contacted Lee Myles Transmissions to inquire about the status of the work getting done on my car they informed me that they didn't have any vehicle with the description of mine.  I called off of work to find out about my car, when I showed them my contract they told me that Mr. Martella was no longer working there and he was told and in fact removed my vehicle from the defendant's property.  I called the police at that moment.  3 days later Mr. Martella send me a message to inform me where my car was taken to.  I called off of work again, with the intention of retrieving my car.  I was not able to do so due to the fact that my SUV had been taken apart.  My car is dismantled now, my deposit has not been returned, and now I am told by defendant whom I entered into the contract with, that is not their problem, is their employees problem(Mr. Martella).  I left my vehicle at Lee Myles Auto Care. I paid a deposit directly to them. I made a contract with them.  My car has been taken apart.  It is in a new location. I have lost my vehicle, my money, and days off work.  I request the full price of my vehicle (paid$4500) attorneys fees, court fees, time lost from work and any legal related fees, as a result of this fiasco.  Thank you for your consideration."

If you get into a problem with Lee Myles Auto Group, Lee Myles Transmissions, please consider suing them.  I won.  You can too.
