LOAN MOD SCAM **** DO NOT DO BUSINESS WITH THIS COMPANY****

I contracted with this company in Dec 2009 when they were doing business under the name of American Platinum Financial Services, to do a loan modification on 3 of my homes.

When I paid my $4000 in fees to APFS, (back when they still had a "B" rating with the BBB) they provided me with a contractual guarantee that if they did not modify my home loans with a "Financially Beneficial" result that I would get a full refund. Not only did they NOT modify my 3 home loans, but 2 of them have been sold in foreclosure and one is pending foreclosure due to their negligence. In fact 2 of my houses foreclosed in July, and I got a call from them in October (4 months later) informing me that they were still working on the loan modifications and asking for additional docs.  They didnt even know the lenders had already foreclosed!! This is typical of the incompetence I have been dealing with for 11 months!

I have already lost 2 of my homes and am about to lose the third and although they have failed to modify my loan, they keep refusing to give me the refund using a plethora of ridiculous excuses. They claim that even though they could not get the loans modified, they spent alot of time on them so they will be keeping the fees. They stall, they lie and they change their story but it all results in unreasonable excuses as to why they cant give me the refund that their contract guarantees.

Chris Sauer, the primary owner, is an unethical business owner that has changed the name of this company 3 times in 3 years to hide from BBB complaints. (Same owners, same companies, same address, new names - if you check BBB under American Platinum Financial Services, you will see the same address and their "F" rating, while they boast an "A" rating under this new name!!! They also did business under the name of National Debt Assistance, who also has an "F" rating on the BBB. Soon, when this company gets an "F" rating they will surely change their name again!)

I have had extensive interactions with Jason Benedict and Joe Comprone, the other 2 managing partners, who apparently do all the dirty work for Mr. Sauer and the experience has been horrible! They will say anything and promise anything to get you off the phone but they follow through with nothing. They keep your hard earned money even when they fail to modify your loans!

What about credit cards? I have them doing my credit cards. I'm I screwed? My credit report is all messed up now. What should I do?
