Luis Carcomo of Lexington Mortgage Loan Modification Department called me at my home and advised me that he was from the loan modification department of Lexington Mortgage. He asked me if I was in need of mortgage help. I told him that I was behind about 3 months on my mortgage and I did not want to lose my home and how could he help? He said he could help me with a loan modification of my mortgage and save my home from foreclosure, but I would have to pay $200 for this service. He sent me paperwork to fill out for a loan modification and requested that I send a money order for $200 for this service. I completed the paperwork and sent the money order. The document said I was to receive a response within 72 hours. 72 hours passed and another week went by and no response. So I called them at 1-877-605-7111 and spoke to Luis. He said not to worry about anything, the modification was going well and the attorneys would send me the final papers to sign. This document was signed by me on September 17, 2008. After not hearing again from them, on Monday, October 13, 2008, I called Luis Carcomo's extension which was the same phone number given above with an extension of 246 and there was no answer. I then called the operator and she gave me another extension of Jake Kuchek at extension 216. I spoke to him about what was going with my modification and asked where Luis was and he said he was no longer working there. So I explained the situation to Jake and he said he would look into and get back to me. He called me back the same day and advised me that I would have to give him an additional $1,500 down for him to begin the modification and a final price of $3,000. And he asked me when could I give him the rest of the money. I told him that I was quoted $200 for this whole modification and no one had told me it was going to cost more because if I could afford $3,000, I could afford to pay my mortgage that was now behind 4 months totaling $4,700. I advised him that I could not pay this amount and wanted my money back. I called my daughter on Long Island because I do not understand these legal matters and I was very upset. She called him and he said that he would not send the money back because it was used for the filing of the paperwork. First he said the file was closed and then now he said he used it for the paperwork. I told him that none of this was disclosed to me. I called my friend who retired as a Paralegal and she contacted them as well. They referred her to the legal department. They said someone from Legal would contact her the following day. Two days went by and my friend called again. This time she was connected to someone who would not give his full name just Steve from Legal and when she asked him to give her his full name that she needed to document the conversation, he insisted that she give her full name to him and he did not have to give her his name. She then said she would record the conversation. He said she could not record. He insinuated that her client was in fact ignorant. She demanded that he repeat what he said about her client and he would not and he hung up on her. She went to their website and found out that all of their locations had been closed down and all phone numbers were disconnected. She called the discrimination hotline and it was closed. We are going to pursue with them on Monday. I am writing this so that hopefully they will be notified and will not be able to rip off other consumers as I have been. I am a 70 year old disabled woman with a language barrier and I feel they discriminated and used this to get money out of me knowing that I had no legal knowledge of mortgage modifications. I have been given a phone number for FLASH which stands for Florida Attorneys Saving Homes and it was formed by the Florida Bar Association. I do intend to report them and to follow other legal courses of action.

I wanted to ad a reply to this post. I am a licensed professional who has personally worked with Lexington, providing my clients with refinances and successful loan modification services. Lexington has been in business for over a decade and maintains an excellent reputation in the community. They are also one of only a handful of firms out there today providing a legitimate loan modification service.

There are a number of statements in the above report that do not add up. Including the reference to a $200 dollar fee. It almost sounds like there was a breakdown in communication or perhaps she was in contact with more then one firm and is unclear with who she believes quoted her a $200 fee. I have worked in the real estate industry for over 3 years, and I've never heard of a legitimate loan modification service charging less then $2500 and upwards to $9500 if the service entails retaining a Lawyer for the client.

There are a number of scams out there today targeting homeowners in trouble. Do your due diligence and check out the background of any firm before entering into contract. I just happen to have inside information and experience with Lexington Loan Modification and knowledge of their standards of business practice. And so while I empathize with the experience this woman attests to greatly, I believe this complaint is not accurate in association with this firm.

Please note the following facts:

1. Prior to Shirley. This company maintained a clean record and five stars in the existence of mortgage lending.

2. Serviced over 50,000+ homeowners across US. If our firm practice such conduct to consumer there should be allot more complaints listed here.

3. Company been around over 9 years+ maintained an undisputable record of achievement in all area. See BBB and licensing.

4. Fact, Ms. Shirley did not personally request refund her application fee. In fact, she asked her FRIEND to pretend that she is an attorney, which she is not. Let's review the character.

5. Borrower information shall not be released without an authorization from the client herself. In this case, that was not provided to us. No difference, your friend wants to get your information and we should provide that information to he/she without your approval. Client information protection is enlisted as highest priority with us.

6. Ms. Shirley made racial remarks against our legal counsel to another employee here because she would not give her last name to our legal for her friend's refund. When asked, she will not go on record nor will she speak in a normal manner instead of speaking over you and a question with question. However, this attorney pretender friend expects us to discuss her friend account with her? Again, there is a privacy act in protecting every consumer that Lexington will exercise and enforce. We have also reviewed her authority in handling Ms. Shirley's account; she has none and no record of authorization in place.

7. In our defense, allegations from Ms. Shirley is nothing but a tactic of deceitful practices. In fact, her friend, the one who pretended as a counsel indicated to our employee that she will damage and bad mouth if SHE DOES NOT GET HER WAY. Let's review the character of this individual for one.

8. Per our legal investigation, Ms. Shirley was made aware of the policy set forth in her AGREEMENT for a loan modification. Be reminded that Ms. Shirley SIGNED and DATED this agreement. This agreement is valid and binding.

9. Needless to say, let's examine her options prior to signing the agreement. Our loan modification experts as well as management did explain everything in detail. Obviously the details are not in question but if Ms. Shirley willfully engaged our service and if she is acting in bad faith when she changed her mind are the questions that anyone should ask. The fact here is Ms. Shirley chose to pay an application fee for our modification dept to explore further if the modification can be done. This is at well and it is a professional service.

10. When Ms. Shirley decided she did not want to modify her loan anymore. Let's stop for a moment and review who is the moving party? In this case Ms. Shirley is clearly is the moving party. Who used superficial and deceitful ways to have her application fee returned even after all the review; examination work was done by us as agreed. This tactic is not acceptable and unreasonable to say the least.

It is unfortunate that Ms. Shirley decided to force this unfriendly tactic. If this was handled with human touch by Ms. Shirley Lexington would have granted her request. There are many out there who can benefit from a loan modification to save their house and their hard earned equity position. Our success rate is as high as 95% and we honor what we do and say. Changing locations simply does not mean that a company is not trust-worthy. We have many offices around the country and we believe again this is a clear issue about due diligent on her part.

Lexington Loan Modification have many satisfied clients who have gone from foreclosure to keeping their homes once again, reduced their principal, rate and lowered their payment. It is again unfortunate that one can point the finger and say that we have not done our due diligences in order to finish what we promise.

In final, let the truth reveals itself and record say million.
