This collection agency "reportedly" had a collection on me from US Bank. In November 2009, representatives at the bank including a bank manager informed me the account was closed with a zero balance. I retained these records for a year, heard nothing, got rid of them. Stupid move on my part I guess.
Liberty Acquisitions held the collection for almost 2 years, all the while collecting interest and not giving me a chance to pay off this supposive debt. I was called for the first time by them on 6/8/11, was served via postal service, the paperwork was TAPED together and mailed to my current address. The court hearing was for 6/10/11 @ 8:30am, in a county I did not reside in nor was served in.
The acting attorney tried to convince me that they served my fathers address and they accepted on my behalf. Well the person who signed it may have the same last name in their books, or a general internet search, which is what is looking like they did. Well only person at that address with anything close to my name is my father, how can he sign when he was OTR in Utah? When he asked for my current address, he wasn't even typing!
So, recap, they hold your collection for 2 years, this being YOUR responsibility to contact them, not the way it SHOULD be, then they falsely serve, then lie on court forms to make themselves appear right!
I would LOVE to see this company and it's employees on an off ramp holding a sign, as for now, I'm making payments and looking towards further legal action to shut them down, have BARs removed, and hopefully criminal prosectution. Not sure how far I can get, but I won't stop till they're homeless. Promise!

I have to tell you that most collection companies send out a letter to the debtor about the debt. If the letter does not get returned to them within 30 to 45 days then they send the Summons and Complaint out to you by process server.
The complaint (usually 2nd page) states what the debt is for including the account number if it was a bank account and so on.
Usually the process server does not need to get any signature when serving the paperwork. A good service company records the service so ask if that is available. Make sure your family at the other address states very clearly that you do not live there and they will not accept the docs. You cannot serve by refusal in colorado to a relative.
