I have made a purchase of 2 bikinis (one size fits all) from Lionella that also goes under the names of:

Asiasupershop

and

Neve Bianca.

On the delivery I discovered that the bikinis sent were closer to size 14 than to standard size (8/10). I am size 6/8 so normally one size items do fit me.

Once I have unpacked the bikini ( one of them) and noticed the size of it, without even trying it on, I have contacted Lionella/Neve Bianca/asiasupershop ( its really hard to tell which company you actually speaking to as the correspondence comes from all of them!)

I explained the issue I had and asked of how to process the return as I am not able to access that on their website as it wasnt working.

They came back saying that the website is working and that they have changed my password and provided me with a new one.

I have submitted the return on their website after that and still have not received any return submission confirmation, so I have contacted them again informing them of it.

I got told that I needed to obtain RMA number. Thankfully they have provided that in the email. Also informed me that: The bikinis can possibly be delivered in a thong style.

I went ahead with the return procedure and sent the order back to them straight away ( sing post with a proof of postage)

Over 3 weeks later I had to chase them with the question about my refund. Response I got: asking me if I had a tracking number ( which I didnt) and then that they will check if they have received it. I have waited for a week for a response and nothing came so I have sent another email asking if they had a chance to check.

They responded saying that: The return has been processed and a refund given according to the returns conditions.

When I checked the refund amount was 31.72 when my original purchase cost was 36.05 + 5.34 postage / packaging fees.

Obviously I have questioned that and been told:

The difference is due to the re-stock fee which were applied for your return.

I have questioned that as well and got told:

Some returns information, which you agreed to during checkout..(Its not possible to checkout without agreeing to our conditions)

When I told them that those charges are unlawful and that I will be contacting consumer websites about that I received this:

Hi, We are sorry you feel that way. We did stretch us quite far on your behalf.
1. we did accept a return of swimwear items, which we clearly state that we do not accept returns of.
2. we help you complete the returns procedure and get the RMA numbers, something you are required to do yourself.
On top of this you did actively agree to our conditions during checkout by ticking the check that you agreed to our terms and conditions.
If you place any "negative" comments  about us or our site, we reserve the right to waive our privacy policy and answer those with the full information detailing that you had accept all our terms and that we on top of that did special exceptions for you.
If any false or defamatory information is posted, we reserve the right to go to further legal steps.
Regards
Nia

I think their terms of agreement are unlawful and to be honest I have not read them on the purchase reason beei8ng all other returns I have ever made with various websites (I do a lot of internet shopping) have pretty much same standard policy and its noting to be feared of. But this firm just had proven that there are rip off companies that will try to make an easy penny on your account.

Please advise.

Kind regards

This is a "complaint" by someone who did not read through the conditions before agreeing to them and then places blame on us for that fact.

When purchasing on our website, the terms and conditions are shown clearly on the screen during checkout and it is necessary to actively accept our terms and conditions.

It is actually not possible to checkout without first agreeing to have read and accepted our terms and conditions.

The terms and conditions clearly state that refunds are only done once the returned items have been received back and inspected, refunds are for items only and that re-stock fees can be applied according to the return departments discretion.

To avoid misunderstandings we urge anyone who wish to order to read through the terms and conditions prior to agreeing to them.
