Below is the story of my nightmare with Lipton Toyota. I've listed the series of events in order:
- I purchased a 2008 Pontiac Vibe from Lipton Toyota on ebay (or so I thought) for below book value.
- The listing stated to contact Rafael DaSilva, Internet Manager. I contacted Mr. DaSilva immediately via email.
- He replied back the next morning saying "the car did not sell for what we expected it to. we should have listed it for a higher price. we will not be selling it."
- So first of all, this was Lipton Toyota's first sale online. Obviously when he wrote this reply he didn't realize that ebay states that if an auction goes off it is a legally binding contract. If an item sells for less than expected, it is not grounds for dismissing the sale.
- I wrote back and forth with Mr. DaSilva who kept getting more and more rude through email to the point where he was basically taunting me. To say he was disrespectful would be an incredible understatement.
- Mr. DaSilva kept blaming the "new sales rep" that listed the car, but according to the item description he was the one who listed it.
- As usual, ebay was of no help.
I guess this is what you get when you deal with used car salesman, but this went beyond anything I've ever seen. I should have read all the reviews about Lipton Toyota and how they engage in shotty business practices. Please save yourself and avoid them at all costs. They are absolute con artists.
Joe

'Google' this- ENGINE SLUDGE, and go to the consumeraffairs website and read Joanne's complaint regarding her 2005 Toyota Prius that evidently had a BRAKE FAILURE. Her complaint was posted on February 5th 2010.

A car salesman trying to weasel out of a deal? Can't say I'm surprised.
If I were you, I'd take 'em to small claims and force them to sell you the car at the contracted price. If they refuse or have already sold it, they they'd owe you the difference between the sale price and the list price. You've got all the evidence you need to show a binding contract.
