I signed a contract to buy a property that was being foreclosed. The seller had been told by Litton that if he got a contract on the house to them by the close of business on June 6 that he could sale the house.

This would prevent the home from being foreclosed on and thus keep a negative mark from off of his credit report. I provided everything asked of me by his realtor, from the earnest money to a pre-approval letter from my bank.

Litton broke the law by not following the law of the state of Texas. It is amazing that this company can get away with this kind of business practice.

I was told by the seller's agent that the home had been sold on Tuesday the 6th of June, which is not what the seller said that Litton had told him. He was told by Litton Mortgage that if he had a contract signed and to them on this day, that it would prevent any foreclosure proceedings.

When the seller's agent contacted me about what was going on, I immediately started researching this company. I now find out that this is common practice with them.

Since I have a signed contract in hand. I believe I have some buyer's equity in the home and believe that this property rightfully belong to me.

Litton Loan Services has been allowed to take advantage of African Americans long enough but not this time. Please someone, help me stop this predatory lender from stealing my home and destroying the sellers name.

Aafes...you obviously haven't dealt with Litton

If you had ever dealt with Litton, you'd be aiming your high and mighty comments on some other person. I've never dealt with a company that so blatently disregards common decency like Litton Loan. Save it for someone who deserves it.

Predatory lending: Sub prime loans

John of Sacramento, California is absolutely correct, race is a very important factor with regard to predatory lending. There are many study's done by advocacy groups and HUD on how African Americans single women, disabled, elderly, other minorities and the most vulnerable of society are purposely targeted into predatory sub prime abusive loans that result in foreclosure.

Let's not deal in fantasy's. Everything is about race. I don't believe John was using his race as an excuse or crutch, but if he feels his race plays a part in his foreclosure than so be it. Who are we to judge him!

If you are not African American, a women or any other minoruity, how can you comment. Making insensitive statements serves no real purpose and does nothng to resolve this horrific predatory (mortgage) foreclosure fraud issue.

Litton is targeting everyone now and has crossed over into the mainstream of society into the Prime loan market. However, prior Litton's main focus was only the sub prime market that does comprise of more African Americans and other minorities.

Litton is a predator and is looking for new fresh meat is expanding now into the prime market that comprises of more whites. This is the reason for your problem of foreclosure and unfair deceptive business practices.

I would like to take this time to apologize for suggesting that this happen to me because of race. This came about because I was angry and dissapointed that I did not get the property. If there was any misrepresentation made here. It was made by the seller's agent and this is where my problem should be solved. Again, thanks for the opportunity to update my initial report.

You are correct in your last response. Race plays no factor in what took place with Litton. I guess I was just angry that it seems that a good deal was missed. Thank you so much for correcting me on this. It does seem however that there are a lot of negative information out there concerning this company and maybe someone if not already should look into it. Thanks

You need more hard information. You indicated that: "which is not what the seller said that Litton had told him..." in regard to the seller's statement.

That statement, in itself, is not hard evidence of Litton making a representation. The mortgage was in foreclosure - in all likelihood the seller was dealing with a Litton's collection department at this point. Collectors are well known for misrepresenting facts and having instantaneous bouts of amnesia regarding a conversation with a debtor.

If the property was in foreclosure proceedings the only reasonable way to handle this transaction was with Litton, not the seller or his agent. As I understand it the home cannot be sold by the lender while still in foreclosure, the foreclosure would have to be completed prior to any sale by the lender.

The seller blatently misrepresented the facts. He indicated to you that no "negatives" would appear on his credit profile if you completed the contract in this time period. If this home was in foreclosure his credit profile is already indicating late or missed payments.

As for this statement:

Pure b.s. It is not required, and is in fact prohibited, I believe, for a loan applicant to indicate his/her race on a loan application. There was no discrimination here. If the seller is of African descent the problem arose simply because he could not pay his mortgage - the same would have happened if he were green. If you are of African descent, Litton could not be discriminating against you as you never applied for a loan from them.

You simply cannot live life blaming every problem on the fact a person or company is discriminating against you because of your race, religion, sex or otherwise. The truth is life is ALWAYS going to bring problems big or small. Just when you think there will never be another problem, the doorbell will ring, you will open the door and a problem will kick you squarely in the groin.
