Lloyd & McDaniel law firm are complete ***holes, RUDE, AND THREATEN ME. I had an old account balance that involved the almost as crazy Countrywide Home Loans, and the debt was dropped due to several reasons. These losers, Lloyd & McDaniel, PLC, dug up this old account and sued us! The added an additional $20,000.00 to the balance.

When I tried to explain to Patrick Kilburn from Lloyd & McDaniel that we were going through a loan modification with Countrywide, PATRICK KILBURN FROM LLOYD & MCDANIEL would scream through the phone that he did not care about Countrywide, so I was never able to finish telling him the modification for the second mortgage was never completed, and the first mortgage was sold to another NUMB NUT, Bank of America, and they dropped the second mortgage (which WAS SMALL BEFORE LLOYD & MCDANIEL DUG UP THE OLD ACCOUNT).

Lloyd & McDaniel threatened us and said if the payments are not made on time I WILL TAKE YOUR HOME! Why are these evil creatures allowed to get away with this, and why had I been informed to send the monthly payment to Patrick Kilburn @ Lloyd & McDaniel??? They are evil, money hungry crooks, and SHOULD BE PUT IN THEIR PLACE!!! I am still dealing with Bank of America and Countrywide, and now I have Lloyd & McDaniel!! Someone please call this firm and make them stop! PLEASE

If these folks got your debit card or account #s cancell the card  and close your bank account and move to another bank.

Patrick Kilburn from Lloyd & McDaniel did threathen me after I would not give him my checking account number and said he would take my house and then screamed "I MEAN IT". I just received papers from Lloyd & McDaniel to garnish our wadges AND I AM DISABLED AND NOT WORKING. Patrick Kilburn has the name of the company I worked for five years ago listed as my employer. I am going to the FTC web site and file a complaint now! I still live in my home. I had a first and a second mortgage BOTH WITH COUNTRYWIDE HOME LOANS. Countrywide sold my first loan to "BANK OF AMERICA" and the second mortgage to Old Republic Equity. We WAS involved with a class action suit with Countrywide because A FORMER COUNTRYWIDE EMPLOYEE SOLD ALL OF OUR PRIVATE AND PERSONAL INFORMATION (including our social security numbers, debit card numbers, both of our loan numbers and information, checking account information) and we still have not received any settlement from Countrywide. Countrywide keeps saying they need additional information!!  We had purchases made in California with our card, and we have never been to California! I recently received a letter from the "CEO" of Bank of America, after I filed a complaint with the BBB, but let;s see what happens! Patrick Kilburn and "Tracy"  from Lloyd & McDaniel are EVIL EVIL PEOPLE. I hope their time comes soon! Thank you for all this helpful information...you guys are great!

Do you still own the house?

It is difficult to tell from your report, but it looks like you had two mortgages on your home; the first with Countrywide and a second with someone else you didn't name. From your report it sounds like you have completed a modification of the first but did not pay on your second mortgage so it was charged off and either assigned to these debt collectors or sold to junk debt buyers.

If you still have the property, then the mortgage lien for the second mortage is still in place unless you have done something to actively get rid of the mortgage lien.  The ways you can get rid of a mortgage lien is to 1) pay it off and receive a Satisfaction of Mortgage or 2) strip the lien in a bankruptcy proceeding. It doesn't sound like you did either of those things. The owner of the defaulted mortgage can foreclose - but it may not be worth it to them to do so depending upon the size of the first mortgage and the value of your property. Or they can decide to wait until you refinance or sell the property and then collect on the mortgage lien plus fees, default interest and penalties.

Get in touch with a good real estate attorney if you still have this property. You will want to negotiate a reduced payoff in exchange for the lien release. There are all kinds of issues - you want to make sure that whoever you pay has the actual authority to collect the payment and release the lien or it won't do any good at all for you to pay them. You need an aggressive, knowledgeable, professional attorney. Not one of those attorney "mills" - (IMO stay away from the big guys that advertise on TV). Interview several attorney's to see if they can work with you effectively.  

Naturally, none of this applies if you don't have the property any more.

They can't threaten you. How old is the debt? If it is out of SOL then they are SOL. Why are they contacting you about an old debt? Palisades and Triadd do this. But they are both bottom feeding jerks. Get a recorder, get them on tape threatening you and then sue them. If what your saying is true then they are violating your rights. Better yet if your telling the truth then contact the FTC and file a complaint against them. Good luck!!! All these jerks should be shipped off .
