The Los Angeles Bureau of Sanitation (BOS) initiated a 'Multi-family Bulky Item Fee' (BIF) on October 1, 2007. Under the ordinance (LAMC 179070), condominium properties of 5+ units are exempt. However, the LADWP has been erroneously billing condo ratepayers (and their HOAs) since 10/1/2007, and at a rate that is double what tenants and their landlords are required to pay ($1.28 per month versus $.64). BOS refuses to notify condo ratepayers of the error, instead removing the fee from one's LADWP bill upon receipt of a complaint. To add insult to injury, BOS will only provide a refund equal to 12-months of charges, rather than a full refund retroactive to 10/1/2007. They insist that a statute of limitations (California Government Code 911.2) bars them from issuing full refunds, notwithstanding their billing error through no fault of the ratepayer!


If you are a condominium owner (or renter of a condo unit, doesn't matter) in Los Angeles, check your LADWP bill. If you are being charged the BIF, call the BOS at 1-800-773-2489 and demand that the fee be removed from your bill. Confirm that you will receive a 12-month credit for the billing error. Also, your Homeowners Association (HOA) is being charged. Inquire about the fee being removed from your HOA LADWP account. In our case, the 12-month only refund policy is costing my HOA more than $1600! I have taken this issue to my local Neighborhood Council. Representatives from the council will soon meet with the Board of Public Works that oversees the BOS. We are demanding FULL refunds of this illegitimate fee. I would encourage all condo owners to contact their respective Neighborhood Council (http://done.lacity.org/ncdatabase/nc_database_public) and request that this matter be put on their next agenda. Also, your council member's field representative might prove helpful in this regard.
