i began receiving parking tickets for parking on my own property on jan 2007. it states i am parking in the front yard. in less than a month, they have issued 14 tickets in error. I cannot begin to express the rage and frustration i have for them now.

the street i live on has old buildings that located very close to the sidewalk, only about 3-5 feet from building to sidewalk. this establishes the required front yard to be less than 5 feet. i have over 13 feet from building to sidewalk.

the los angeles department of public works bureau of engineering accepted and signed off on a class "A" permit to build a new driveway to park in front of my building behind the required front yard setback.

i contacted my city council district #13 office for their assistance. but they were not able to help me, parking enforcement still maintains the tickets are valid even though i presented photos and copies of the class "A" permit and application which clearly states "per building and saftey, ok to park behind front yard setback"

even after i clearly displayed a copy of the class "A" permit on the dashboard with a note attached specifically for parking enforcement, they still continued to issue tickets. do they not know how to read????

so now i'm forced to find street parking in my neighborhood which sorely lacks street parking. after all the time and money spent to create a driveway and parking area, i cannot use it!

to top it off, there are many residences (14 within a 3 block radius)in my neighborhood that have completely cemented over their front yards to illegally park and yet are getting away with it.

one morning, when i received yet another parking ticket, i drove around (6am)and saw that none of the people that have illegally paved over their whole front yards and park received any tickets.

is there a class action lawsuit? please advise.

update- good news!

my council district was unable to assist, but i was able to contact the captain of parking enforcement in my area and explain everything.

seems a neighbor complained, but after faxing the permit, all 12 tickets are in the process of being dismissed and noted to stop ticketing on my property!

Sun,

First, ditch the class action idea. Your situation isn't appropriate for a class action lawsuit.

Second, be sure to contest the tickets. If what you say is correct, then a simple court hearing, wherein you present the evidence showing that the City has already determined that you are permitted to park in this matter, should result in a quick dismissal of the tickets.

Third, you should seek a declaratory judgment to the effect that the manner in which you are parking is not violative of the parking ordinance. This would basically, for all intents and purposes, result in a judicial order enjoining (think "injunction") the City from ticketing you in the future.

You should be able to do step two without a lawyer. Step three is a bit more complicated. You could do it without a lawyer by filing a complaint with the local courts. Said complaint would simply set forth the fact that you possess the permit, the effect of the permit, and that the City is nonetheless ticketing you. The end of the complaint would be a "prayer for injunctive relief" ordering the City to cease ticketing you for parking in this matter. You would be MUCH more likely to succeed in this plan with a lawyer, but I understand that it may not be cost feasible to hire a lawyer for a parking issue.

I haven't looked at City of LA "Parking Violation" ripoff reports for some time, but can certainly empathize with you. (Although I've never lived in California or LA, after what I went through a couple years ago with the abundant violations of California State law by the parking enforcement operation administered by the City of Los Angeles, I will never set foot or wheels in the City of Los Angeles again, ever.)

You'd have to go back and search these ripoff reports for the many complaints about the City of Los Angeles by placing the word "parking" in the box above the scrolling reports. Then look for the Los Angeles complaints from a couple of years ago. In them there are phone numbers and names of people hired by the City of Los Angeles as troubleshooters to resolve unwarranted parking tickets. Sorry I don't remember their names, much less the phone numbers, but others have been helped by them. Maybe you could meet with one of them and show him/her your Class "A" permit with its clearly defined stipulations. The parking ticket issuers also are employed by the City of Los Angeles, so perhaps there's a possibility of ending the harassment you've been subjected to.

Although a California state law was enacted a couple years ago that prohibits the implementation of "quotas" for parking ticket issuers, your story here sounds like that law is being circumvented. Despite the clearly stated wording of the permit, the issuer possibly "can't read" because of an unwritten policy in place so he can keep or be promoted in his job. That's pure speculation, but irrational behavior and the issuance of bogus parking tickets in the City of Los Angeles a few years ago was the norm.
