In October 2013, on a visit to Los Cabos, we were enticed into a timeshare presentation with the promise of free rounds of golf at famous golf courses in the area. We were taken by van to "Los Cabos Golf Resort", over an unfinished dirt road that led to a gate-guarded property in sight of the local Walmart. We were offered breakfast, toured the vacation resort property, and then we were led into a large room where other guests were sitting at various tables listening to timeshare sales talks.
We were asked if we ever owned any timeshares; we said we own Mayan. They offered to buy our Mayan timeshare at a premium in exchange for buying a timeshare at Los Cabos Golf Resort. Since we hardly used our Mayan timeshare this was very attractive. Supposedly, the deal would result in a net $16,000+ to us. By that time we had been there nearly 3 hours and had spent over an hour listening to their talk about the merits of this deal. At times, we were "two-teamed" by salesmen. Almost exhausted by this time and wanting to get out of there, we agreed to the deal, then signed many papers, supposed "closing documents" for the transaction. We used our American Express card to pay $15,000 (plus transaction fees) for the Los Cabos Golf Resort property; we were led to believe that within 180 days, we would be given the $16,000 in exchange for our Mayan property, per the "Escrow" document among the closing papers. As other victims have reported, this is a false promise based on worthless documentation.
Beware! We were told by the sales team and we signed several documents waiving our rights of recission and verifying that we had received all goods and services as promised. We later learned that Mexican Consumer laws allow 5 days for recission, that this right of recission cannot be waived, that this information was intentionally misrepresented and concealed from us. Internet research revealed that many others have been scammed by these crooks.
We have hired a Mexican attorney to file an action in Mexico and we have filed a dispute with American Express. However, we believe we have only a small hope of recovery of our money, given the clever way the sales documents are drafted by these crooks. NOTE: This property was previously known by other names including Signature Residence Club. The merchant named on the American Express payment slip is "Luxxury Leisure Colletion (Jogolo S.A. de C.V.)." Other name on the documents: "Premier Property Management."

Often resort developers hire an outside sales/marketing team. As everyone knows there are good and bad people everywhere. Timeshare historically has had a bad stigma but with the entrance of luxury brands and adjustments to the actual business models, customer satisfaction has increased greatly over the years. Unfortunately there are still some unscrupulous companies and organizations that drag down the whole industry perception. The team that was doing the sales and marketing for the Los Cabos Golf Resort was found out to be deceiving and unscrupulous and fired as a result.
The new developer has since hired and partnered with a new team with a proven track record of honesty and integrity. The resort program is righteous and new owners are very happy. If you were a victim of 'signature vacation' or 'luxury leisure collection' please contact the resorts sales department for solutions. It's really too bad that a few bad apples can spoil a whole barrel. This resort has been here for 18 years and almost 70% of people who purchase, purchase more. Since that group was fired there have been hundreds and hundreds of people purchase who you don't hear from because they are happy.

This matches our story exactly. Patrick Fernandez, Luxxury Leisure, Los Cabos Golf Resort were all mentioned and seemed to be part of this scam. They were even mentioning the new Tiger Woods Diamante Golf Resort as part of the scam. I have a certificate of membership at Los Cabos Golf Resort but they are not honoring it. This scam took place on the second floor of the LCGR.

The best advice is NEVER buying a timeshare anywhere. It is a scam and the so-called timeshare you buy is sold over and over again to other people. It is very difficult to sell your timeshare now and renting isn't in the deal. It will cost you more to buy a timeshare and maintenance fee than to rent a hotel room or a full ownership of a condo. We are searching for legal counsel now ourselves. Would it be possible for us to contact your lawyer while we're here in Cabo? Would be very interested in joining the fight to get these theives shut down, and there's 35 pages of others in the same boat with postings on trip advisor under Los Cabos Country Club, Signature Residence Club and Luxxury leisure Collection. Thank you for your comments about the Los Cabos timeshare scam "Los Cabos Country Club". As noted we have an attorney in Cabo looking into this for us and pressing a claim with the federal Consumer Affairs office. However, I would not be surprised if the result is a verdict, finding or judgment against a corporate entity that has "empty pockets." Given the number of complaints we discovered, it is likely that the scammers have figured out ways to protect their assets from seizure. If however, you are able to find an attorney who feels there is merit to our claims, that recovery is possible and who is willing to fund a class action suit, then we would be willing to join in.

Our situation is eerily similiar to yours. We too "sold" our existing membership to Los Cabos Country Club resort for a generous price with the promise of our money paid within 90-120 days....Of course, now reading the numerous complaints from so many others, we're not holding our breath. I'm no longer embarrassed that we got taken..I'm furious they keep getting away with it!! I'd love to join you in your legal fight to shut these scammers down for good..They are a detriment to the Mexican economy and reputation. Most timeshare companies are taking advantage of people, often those who are more vulnerable and less able to resist hard sales tactics. I have heard of many cases where maintenance costs rise well above inflation. It would appear the timeshare companies lock people into contracts and then drive up their profits though increased maintenance charges. It would be good to see legislation whereby timeshare companies can only charge "reasonable" maintenance costs and not use this annual fee to fleece people's bank accounts
