This is a complaint against Lowes Home Improvement @ West Chandler, Arizona for intentionally damaged both my husbands and my credit reports with credit agencies and failure to refund the balance due as I have requested on my Lowes account.

With Lowes special promotion for both 10% discount on purchase and a 6-months defer credit plan, I ordered kitchen cabinet material to be installed on May 28, 2000. It is to my regret that it took eleven months to complete the installation of my cabinets eight months behind schedule. The cabinet design by Lowes was faulty and there were numerous cabinets returned and exchanged. The resulting confusion on the installation of our cabinets forced me to reconcile the charges on my Lowes account. Below is a list of facts that I have encountered with Lowes:

A)Under the Fair Credit Billing Act, my letter claiming a billing error must be acknowledged by the Lowes in writing within 30 days after it is received, unless the problem is resolved within that period. In any case, within two billing cycles (but not more than 90 days), Lowes must conduct a reasonable investigation and either correct the mistake or explain why the bill is believed to be correct. Fact: Lowes fails to resolve or explain my dispute for the cabinet charges within two billing cycles. In fact, As of 06/30/2003, Lowes has not provided me with any explanation or clarification for charges of cabinets on my Lowes credit card, including those items that were returned and picked up by Lowe's.
(B) Under the Fair Credit Billing Act, I have disputed about billing errors on my Lowes credit card for the followings:
Failure to credit the returned merchandises for items pick up by Mr. Tom Rose @ Lowes on 02/04/01.
Failure to provide the explanation or clarification for charges of the cabinet installed as I have requested.
Failure to provide the proof of bad debt discharges of 2,953 as I have requested
Charged for cabinets we didnt accept and not installed.

(C)Under the Fair Credit Billing Act, I could have withheld payment on the disputed amount during the investigation and pay part of the bill not in question.
The dispute amounts were $20,174.37 and $2,127.89 (a total of $22,302.26) and the non-dispute amounts were $2,433.50, $248.50, $5,461.20 & $3,834.32 (a total of $11,977.52.)

Under the Fair Credit Billing Act, I was required to make the non-disputed amount of 11,977.52 by the expiration of promotional date 06/02/01. However, please note that I made a payment of $29,951.72 to my Lowes credit card account on 05/31/01 via Overnight Deliver. The status of my Lowes account was current as of 06/02/01. But Lowes intentionally damaged both my husband and my credits by reporting derogatory information to Credit Agencies.
(D)Under the Fair Credit Billing Act, while the dispute settlement procedure is going on, Lowes may not take any legal or other action to collect the amount in dispute. During the dispute period, Lowes has engaged two collection agencies to collect the disputed amount: Jerold Kaplan Law Office, PC and Wolpoff & Abramson, LLP
(E)Under the Fair Credit Billing Act, Lowes may not threaten my credit rating or report me as delinquent while my bill is disputed.

Fact: Lowes had improperly reported both my and my husbands accounts as delinquent and bad debt charge-off to the credit bureaus The only derogatory report for the charge-off on my credit report was from Lowes and, as a result, I have been refused credit for my credit application. I have spent enormous time and efforts to provide Lowes with detail explanations for the charges on my Lowes credit card account. After two years on 06/09/2003, Lowes finally admitted its mistake by agreeing to delete all derogatory information from our credit bureau file.
(F) The finally issue: Under the Fair Credit Billing Act, Lowes must promptly credit or refund overpayments and other amounts owed to my account. I have requested refund on my account as early as 01/03/02. I have yet to receive the refund from my Lowes credit card account.

I have serious problems with Lowes West Chandler store# 674 and Lowes Monogram Credit Card Bank of Georgia. Lowes had willfully and intentionally filed derogatory information to both my husband and my credit bureau files and Lowes owes me money.

I have to provide Lowes with a copy of the Fair Credit Billing Act from the Federal Trade Commission to prove to them that they were violating the Federal laws. Lowes also employs every tactics possibly, including deception, false statement, false pretense, false promise and misrepresentation, to thwart my attempt to resolve problems.

Lowe's has not dealt fairly with me, nor are they unwilling to respond to my legitimate complaints. I got the runaround among Lowes West Chandler store #674, Lowes Customer Care and Lowes Credit Card Department. I suffered great inconvenience, repeated annoyance and frustration, in addition to increased loss of time and money.

The problems began on May 28, 2000; I ordered kitchen cabinet material to be installed from Lowes West Chandler Store #674. The cabinet designs by Lowes were faulty and the cabinet installation took three or four different cabinet installers to complete the project.

The cabinet installation took 11 months - 8 months behind the schedule. There was an unauthorized charge of $ 2,127.89 on 06/20/2000 by Lowes employee. Furthermore, there were numerous cabinets returned and exchanged. To make the matter worse, I was unable to get cooperation from Lowes West Chandler to reconcile the cabinet charges on my Lowes account.

Thus, I formally initiated the dispute of cabinet charges on 05/16/2001. And, pursuant to the suggestion of the Lowes Customer Service @ (800) 444-1408, on 05/31/2001, I sent a payment of $29,951.72, which represented the entirety of my Lowes account.

I included a letter explaining our calculation. Lowes, however, continued to bill me a balance due for which I asked and requested for an explanation and clarification. As of 07/09/2003, Lowes has not provided me with any explanation or clarification for charges of cabinets on our Lowes credit card or the alleged balance due.

Below are some selected facts:

Lowes fails to credit the returned merchandises for items pick up by Mr. Tom Rose @ Lowes on 02/04/01. Lowes fails to credit charges of cabinet that we didnt accept and were not installed. On 06/20/2000, Lowes made an unauthorized charge of $2,127.89 on my Lowes account and refused to credit back this charge.

I disputed my cabinet charges as of 05/16/2001. My account was current as of 06/01/2001. For more than 2 years, Lowes has improperly filed derogatory reports of delinquency and bad debt charge-off of $2,953 to the credit bureaus files and attempted to collect the disputed amount by engaging two collection agencies : Jerold Kaplan Law Office, PC and Wolpoff & Abramson, LLP

Lowes alleged there is a bad debt discharged of 2,953 on my Lowes account. But, Lowes has not been unable to provide the proof of such a debt. In fact, I have asked Mr. Kevin Miller, Store Manager of Lowes #674, whether he could provide me with the detail of charges on Lowes claims. He said NO! As of 07/09/2003, Im still going after Lowes to correct our credit reports problems. What a shame!!!!!

Lowes owes me money since Lowes failed to accept my payment of 05/31/2001 as its entirety. As of 01/03/2002, I have provided Lowes with the preliminary calculation for the money Lowes owes me. I have requested refund on my Lowes account as of 01/03/2002 and I have yet to receive the refund from Lowes.

Lowes refused my offer made on 05/21/2003 V Credit $245.47 to my Lowes account and update our credit reports within a week. It was my understanding from Mr. Kevin Miller that he was willing to credit $245.47 to my Lowes account, but, Lowes Credit Card Department would not remove our bad credit reports because there was a bad debt written of $2,953 on my account. I asked Mr. Miller whether he could provide me with proof of bad debt $2,953. He replied NO.

Lowes finally could not lie about the bad debt written of $2,953 on my Lowes account. On 05/30/2003, I provided Mr. Kevin Miller and his credit specialist with a copy of Fair Credit Billing Act. I met and provided Mr. Miller and his credit specialist each a 27-page document. The three of us spent two hours discuss and reconcile the charges on my Lowes account.

To my dismay, Mr. Kevin Miller told me that Lowes system was operated in such a way that when he credited $245.47 to my account, the previous written off $2,953 automatically popup. Accordingly, he requested that I agree to make cash payment (phantom) of $2,953 on 05/30/2003 even if I do not have paid for it.

With todays current technologies, I was perplexed as to why Lowes was not equipped to handle its billing error entries or adjustments. It appears that the conduct of Mr. Kevin Miller was acted in deception, false pretense and misrepresentation of material facts V consumer fraud. It was my understanding from Mr. Kevin Miller that he was working with Ms. Karen, Recovery center of Lowes Credit Department.

On 06/05/2003, through Lowes Customer Care, I requested refund on my account and again was ignored. Accordingly, Billy, Lowes Customer Care, forwarded my request to senior management.

I waited and waited for my refund. Twenty-five days later, on 06/30/2003, I informed Billy that if I do not hearing back form Lowes about my refund, Ill file Rip-off Report against Lowes. Then, Mr. Kevin Miller called and said that he had fixed our credit reports and that he had consulted with Lowes Legal Department and Lowes Customer Care about the matters.

Accordingly, the matters with my Lowes credit card account were closed. Mr. Kevin Miller provided false promises about my refund claims. First, on 05/24/2003, he agreed to credit$257 to my account. Then, on 05/28/2003, he further agreed that I could claim additional refund if I met with him and his credit specialist to reconcile my cabinet charges.

I filed the Rip-off Report against Lowes on 06/30/2003 after Mr. Kevin Millers made the remark about the matters on my account were closed.

JUST EXACTULLY WHAT IS WRONG WITH LOWES!!! WE CANNOT LET LOWES GET AWAY WITH IT!!!

Lowes still us owes money on our Lowes credit card account. Lowes still has not acted in good faith to correct our credit report records. I want Lowes to compensate us for inconvenience that Lowes has caused us, such as hours spent on disputed process, damages on derogatory credit bureau files, transportation, business lost in dollar and aggravation & stress.

07/03/2003, I finally contacted Mr. Robert Livingston Tillman, Chairman and CEO in the hope that he could break through a logjam. Instead, I get transferred from one staff to another, but so far nobodys willing to admit that this problem falls within his or her purview. On 07/08/2003, it was my understanding from Mr. Richardson, staff of Lowes corporate office at NC, that those corporate officers do not know anything about laws; thus, they will not respond to my complaints about Lowes violating the law.

Accordingly, I should not expect to hear from those corporate officers. In Particular, Mr. Richardson told me that Ann, Lowes Senior Manager of Credit Card Department, spoke to me on 06/07/2003 and she noted on file that Lowes has written off the our delinquent balance on 06/04/2003.

I told Mr. Richardson he should know that Anns notes about the written off the delinquent balance on my Lowes account were a very serious false statement V consumer fraud. In other word, Anns note stated that she had written-off the bad-debt on my account.

Clearly, Ann, as a senior manager of Lowes credit card department, knew or should have known there was no delinquent balance or bad debt on my Lowes account. Instated, Lowes violated the Federal law - committed the billing errors on my Lowes account and, inappropriately, damaged our credit reports.

With Lowes that proves unwilling to respond to legitimate complaint, we have contacted a consumer advocate from the badbusinessbureau.com whom I will be employed to assist the picketing activity in front the West Chandler Store #674 and its parking lot until the issue is resolved. The picket is scheduled to begin at 10 am on 07/12/2003.
