I have been litigating a case against this California attorney and am quite frankly appalled by his utter lack of professionalism. I had the opportunity to litigate against him when he accused my client of wrongdoing. His case was based on the declaration of a witness who was paid thousands of dollars in cash to testify (still unsure if Luis had anything to do with this as it was his client, Jeffrey A. Cancilla that tendered the cash in exchange for a favorably worded declaration). His client, Jeffrey A. Cancilla has already been suspended by the State Bar.
Then Luis Magdaleno notices my clients deposition. He arrives an hour late complaining the traffic slowed him down (keep in mind this is Southern California, traffic is as sure as the sunrise). Then at the Case Management Conference, all parties have to wait an extra hour because Luis Magdalenos phone line in his building is incapable of transmitting a normal conversation.
To top it off, I personally mailed discovery to Luis Magdaleno back in November. Written discovery must be responded to within 30 days or the party responding loses their right to object. Lus first response to the discovery is several days late and 75% incomplete. To top it off, he includes objections and threatens to seek a protective order. Despite 32 years in practice (so he claims), he somehow missed out on the fact that he lost his right to seek a protective order by not responding in time. In fact, as I post this in January more than 2 months after mailing the discovery, hes still missing half of his clients responses.
Stay away from this attorney; youre better off representing yourself. This silly complaint was made by Brian J. Colombana who is a disbarred lawyer I sued on behalf of three of his victims. He is the mastermind and principal crook in a country wide series of scams. He was chased by at least 20 Attorneys General across the country for defrauding people under the guise of doing loan modifications. His Liberty Law Firm, Inc. company was even being investigated by the FBI for fraudulent practices. He listed his address with the California State Bar as being in Ecuador while he engaged in his country wide scam from Orange County.
One technique he uses is to defame and libel people on the internet, often from concealment or through surrogates. This is one such effort.
Truth is my Bar record is clean after 33 years in practice, and I have litigated nearly a doze cases against this scam artist directly or in which he was involved as an instigator and accomplice, which frosts him to no end. To date, I have prevailed in every action which has concluded involving him, a total of 9 of the 12. The other three are pending. Please go to the California State Bar website www.calbar.org and look me up as well as looking up Brian J. Colombana. His bar record will be all you need to see to weigh the credibility of any claim he makes against me or anyone.
