After three years of battling Home Town America, Berryman's Branch Homeowners Association obtained a court decision against Hometown America giving final judgment to them as tenants and ordering damages be paid to all the individually named tenant-plantiffs based on unlawful procedures used to demand rent increases for two years and unlawful rent increases and changes made in the first year's leases in violation of the mobile home park act.  The court decision even found the owners/management committed consumer fraud based on their practices of raising tenants rents and changing  tel IDS at any time within the first year's lease in violation of the mobile home park act.  The judge ordered Hometown America to pay treble damages to the members of the association. When they began challenging Hometown America for their practices and policies, Hometown America told them that they wouldn't be successful in winning this case.  Many owners were afraid to join the association. A lawsuit was filed against Hometown America and management in May of 2007 for violations of their rights under New Jersey landlord-tenant laws and the Consumer Fraud Act and the result was the above. Anyone who lives in a community owned by Hometown America is subject to the above practices and needs to check their leases to make sure the same thing doesn't happen to them.
