Joe Weaster and Macadam-Forbes Construction took our money ($46,780.05) we've paid Joe Weaster and Macadam-Forbes Construction for a remodel of our home and walked off the job leaving us with an incomplete, damaged and unusable home.

Joe Weaster and Macadam-Forbes Construction refused to pay his sub-contractors for their work and materials.

Joe Weaster and Macadam-Forbes Construction has refused to offer any explanations for their actions or reimbursement of the ($46,780.05) we've paid to Joe Weaster and Macadam-Forbes Construction for the remodel of our home.

When we asked Joe Weaster and Macadam-Forbes Construction if he was stealing our money and ripping off his sub-contractors he replied by e-mail: " spend time and figure it out ".

MR kirkpatrick lied..its just that simple. he filed 3 complaints with various agencies in austin, all 3 were thrown out.  He then tried to file criminal charges, that was thrown out of court and all charges dropped.

he got $46,780.05 worth of work and $46,780.05 worth of a brand new kitchen, living room floor, painting, sheetrock repairs, termite damage repairs and much, much more.

what Mr kirkpatrick is unwilling to admit is that he falsified photos (showing work that was substandard) that was not in my contract.  stating i would do work that was not part of the original contract. showing damage that was done to the house prior to my starting the project on sections of the home that were not part of my contract.  he fails to state he would not pay for the extras.  he refused to seek another place to live during construction (he stated they would move during construction) which made my job that much harder.  damaged funiture he stated that we did was done by his dog prior to my starting the job or either done when his dog sleep on it when it was in the garage...

when he wanted for me to pay for a change order that he requested for the countertop and i refused he got mad and threw me off the job.  what he didnt know was that i had already pulled my people off the job until he paid for the outstanding extras that were due.

he lied from the day that i would not return until the day we showed up in court.

and then he was confronted with having to produce evidence to support his alligations, he realized he could lie no more.  the case was dropped as were all charges.  and Mr kirkpatrick is left with just the fact that he paid more money fo file the charges and he is still a lying vindictive homeowner.

every dispute that has ever occured between myself and a homeowner has been succesfully resolved..except this one

i have completed thousands of remodeling projects since i started this business in 1992.  the vast majority have turned out wonderful, ive had some complaints as does any contractor that has been in the business as long as i have, they all were resolved.  but i have never been called a thief.  that is just a LIE

Scope of damages caused by Joe Weaster and Macadam-Forbes Construction

Personal property missing, damaged property and items paid for but never delivered and/or incomplete from remodel by Joe Weaster and Macadams-Forbes Construction as of 7/27/08:

Laundry Room

1.Roof over new laundry room leaks above laundry room door. No sub-roof was used, no flashing was used, roof is not screwed in to deck, pieces of siding missing, caulking applied will impead flow of water, roof installed is completely useless. My existing roof was damaged by Macadams-Forbes demo of the old roof. (Pictures).
2.Drain from washing machine backs up and floods floor. (picture)
3.Patch in laundry room wall where drain attempt to repair washer drain failed, left no paint or texture. (picture)
4.Unfinished electrical work (exposed live wires 220, no fixtures or plates)
5.Base boards and door molding (unattached, unpainted, unfinished)
6.Sheetrock not joined to exiting rock wall. (Picture)
7.No HVAC duct

Patio

1.No patio delivered (picture)
2.No clean up. Patio area left littered with appliances, garbage, etc: (picture)
3.Unfinished electrical, exposed live wires, untraceable to any switch or breaker.

Upstairs:

1.Popcorn ceiling not removed (picture)
2.Electrical exposed Aluminum 220 live wires (Picture)
3.Scratched wood floors (Picture)
4.Paint and trim unfinished. (picture)
5.Insulation in attic not replaced.

Kitchen

1.No appliances hooked to electrical (see receipts)
2.Electrical: inadequate, purchased new breakers, breakers missing from box, rebalanced from breaker box, no outlet covers (see receipts, pictures)
3.No tile back-splash (photo)
4.Counter-top, no bar (photo and blue-print)
5.Counter-top, deep scratch at L (photo)
6.Counter-top, cracked island (photo)
7.Vent hood not installed (photo)
8.Vent hood duct work bent in removal and left to rust in back yard (photo)
9.Pantry: no electrical lighting, no shelves, no door (photo)
10.Closet: no lighting, no shelves, no door (photo)
11.Waterline behind dishwasher/ ice maker leaking. (photo, receipts)
12. Cabinets: nails visible in face, no stain on corners, no knobs, plywood visible through knot holes, no custom off site finish (cabinets stained in garage and have saw dust trapped in stain), cabinet doors not from Quality Doors (photo)

Master Bedroom

1. Light fixture over bed: exposed live wires, one light will not work, short (photo

Guest Bedroom

1.Electrical, exposed live wires in closet, no light installed (photo)

Personal Property Missing and/or Damaged

1.New Thermatru Door $800.24 (Joe Weaster said he was returning the door to BMC West for a refund as the door did not fit. In fact Joe Weaster did not return the door; he kept the door. This is verified by John Adams at BMC.
2.Couch (green and red) torn cushions, stained, covered with saw dust (picture)

5.2 Stanley Saw Horses (missing)
6.Carpet on stairs: stained, covered with saw dust (picture)

8.Drapes/curtain rods/ hardware (missing 2 drapes, rods bent, hardware missing, 2 drapes recovered are stained (McDonald's food left on drapes) and covered with saw dust. (Picture)
