macey&alman Legalhelpers.com paid in full 5 mounths ago will not my return calls lost paperwork refuse to let me talk to my attorney, told I dont need to, would not let me talk to upper management. vary rude. nothing!!! kalamazoo, Michigan

I have been a so called customer of legalhelpers.com[Macey Aleman] since February 09 2009. Since then I have not once been contacted by LegalHelpers.com, unless I contact them first. In early April I made one payment. [the exact amount stated on the contract] About 4 weeks later [May] I noticed my check had not been cashed, so i called them, I was told the check was in my file and would be cashed soon and it was. A couple weeks passed after my check was cashed,[June] I decided to call back. This time I was told there was a balance due on my account, I told the gentlemen I had paid in full. Then he asked how much I paid, I told him the exact amount that the contract called for and my check had been cashed and cleared for over a month. After all the time I spent on hold and the lengthy period of time on the phone while legalhelpers got there records strait, I was told they would start soon. In July I called back many times. I was told they needed a income verification form they Emailed it to me, I told them not to contact me through Email or the phone number I originally provided them [I had no access to them] and I gave them a new contact number, I retrieved the form filled it out with a notary and returned it promptly and still nothing. The next time I called back, I was told they had not received it and to send a copy. I asked is a copy OK!  the original had to be signed in front of a notary. then I was told they would Email me another one. Again I told them my new contact information and was told my case was all wrote up and all they needed at this time was a the income verification form. I was able to get the fax after a few days. I called back to see if they found the original form, they did. I was then told my case had not been started yet [guess what I was pissed and let them know it] I then asked to talk to management. I told management my problem, she did not want to here my aggressive displeasure and told me not to talk to her like that because she did not know anything about my case, I responded! Then let me talk to the person handling my case. Then I was then told I do not need to talk to them, she could handle it. I then asked to talk to her manager, the response was you don't need to talk to them either, after a heated argument she hung up on me. I have called back numerous times and get the same result, but while on hold I hear that [I can speak with an attorney 6 days a week][high level client service][vary accessible] I have requested to  be contacted by my attorney to many times and no response. Today is August 27 2009 any suggestions

First I have a few questions.


Are you filing Chapter 7 or 13?


Do you have any immediate need for bankruptcy protection (i.e. is someone trying to foreclose, repossess, garnish, seize, that sort of stuff)?


It's apparent that you are not receiving the level of service or attention that you should be getting. A colleauge of mine works for this outfit, and I know him to be an excellent attorney and highly dedicated to his clients. Unfortunately, this firm is run like a mill which, in my opinion, is not appropriate for a bankruptcy practice.


If you don't have any assets that are in immediate jeopardy, I would suggest writing a letter to the attorney assigned to your case with a cc to the managing attorney of the office you are working with.


Be clear and concise. Lay out a chronological detail of your experience so far, just like you did in your report. Demand a return correspondence within 10 days letting you know what, if anything, is still needed from you.


Inform them that, after receiving said correspondence, you will deliver/pay whatever is still needed within 10 days.


Then demand that your petition be filed within 10 days of their receipt of said items. Overall, demand that, so long as you comply with their requests, that your petition be filed within 30 days from their receipt of your letter.


Tell them that, if they are unable to meet this demand, you would like a refund of all money paid to them thus far so that you may retain alternative counsel.


NOW, if you have assets that are in immediate jeopardy, you need to get a petition in QUICK, and this is unlikely to happen with this firm. If this is the case, I would recommend that you find another lawyer ASAP. Look for a local, small firm that does not exclusively practice bankruptcy. Make sure that whomever you retain can commit to an expedited filing (provided that you submit all requested documents right away).


I practiced bankruptcy law for about a year and a half. In that time, I never saw an individual case wherein the petition couldn't be filed within a few days of my receipt of all necessary documents and payments.  And yes, I'm talking post-BAPCPA.
