Here is the story on Theresa Macleod the oldest of two sisters. There father owned a farm in upstate NY. Theresa left the farm about 25 years ago to go on with here life and pursue her career. Which is very understanding. The younger sister who we will not mention here had to care for the farm and her sick cancer sick mother and man the farm for her father who had a heart attack. She never had any social or personal life because of her responsibilities. Well 7 years ago she final met a man and they fell in love. He worked a very high paid job and decided to leave it to man the farm for her sick father and knew she was falling apart from the stress of a 300 acres farm and he made the decision to do what needed to be done to save the farm. He was 16 years older than her, but when love meets, age doesn't matter. Theresa well never like this man because of the age difference and that he was married once before. She used to call the father and tell him watch him because he is going to steal the farm and rob you. Well the father was a great man and told her mind her own business and he was not dumb or had dementia. She hung up on him and was very mad. Well even after 2 years of him trying to run the farm for the ill father, no money was being made to keep things going. They decided to take the father to Florida with them because of the cold and find a winter place to stay out of the cold. Well while being down there they talked and the father decided to put the farm up for sale. There is one other part of this story; he had a girlfriend after the mother died. She was not even cold in the ground yet. But never the less it is his life and his decision. Well she also started to get involved because she was aware that a 300 acre farm would go for quite a bit of money. So while they were down here with us, they went to see a cousin about 3 hours from here. And the scam started. The cousin, the girl friend and the sister, decided to meet in NY the next summer and meet with an attorney while the younger had no idea and prepare a will for this nice old man. With Theresa being the executor of the will. The younger sister is 38 at this time and has a nice government job and a high level of education. There is no need for a executor of a will in this case. Well between the girl friend and Theresa they talked him to making her executor and making that the younger sister only get 2,500.00 every three month of a total of 10,000 a year.
Till this day the younger sister has never been provided with any financial of the will. How much was left and any balance to this day. The younger sister called the attorney that handle the will and will not give her any information. We have contacted many places and there is nothing we can do. Is Theresa guilty of anything here, or is she just a caring sister looking out for her younger sister well being? And the last question is that if she can do this to her flesh and blood, what is she capable of doing to a future customer.

WILLS ARE PUBLIC RECORDS--1ST OPTION--THE SISTER CAN CALL THE PROBATE COURT AND DISCUSS THE SITUATION WITH THE COMMISSIONER OF ACCOUNTS (FOR VIRGINIA) OR WHATEVER THE TITLE IS IN NEW YORK AND THEY SHOULD PROVIDE A COPY OF THE WILL ESPECIALLY IF THE SISTER IS IN THE WILL. 2ND OPTION, THE SISTER CAN ASK A TITLE ABSTRACTOR TO GET A COPY OF THE WILL FILED IN PROBATE COURT--JUST SEARCH FOR A TITLE ABSTRACTOR OR TITLE COMPANY IN THE COUNTY THE WILL WAS FILED AND THEY CAN GET A COPY (ABOUT $100). YOU DON'T NEED TO GO THROUGH THE ATTORNEY THAT SIDED WITH THERESA--THE SISTER WON'T GET ANYWHERE.
IF THE SISTER WANTS TO CONTEST THE WILL, SHE WILL NEED TIME & ENERGY TO DEVOTE TO IT WHICH IS NOT DIFFICULT BUT TIME CONSUMING AND EMOTIONALLY UNPLEASANT. SHE CAN SEARCH ON HOW TO CONTEST A WILL IN HER COUNTY IN NEW YORK? Whatever the case, should not the sister have a right to what the will was and the amount it was and what was spilt and what her balance is. What are you a ex boy friend?

You are mistaken. In New York State, whenever there are assets in the estate, there must be an executor of the estate. If the will does not name an executor, then the PROBATE COURT will name an executor.
The duty of the executor is to manage the estate and to PAY any outstanding claims against the estate (this is accomplished FIRST.) If there are any assetts after all estate debts are satisfied, the executor then disperses the assets in compliance with the directions in the will. If the will does not include any apportionments, then the executor liquidates the estate as the executor deems fit.
BTW, next time you post a ROR and a rebutal, you might want to use a different logon. You posted as chris and then made a "by author" rebuttal as Ken. Maybe you should but out and mind your own business.

Theresa did this while the father was in a dementia state and the girl friend call her to come up and they took him ot the attorney. they made him beleive that it was best that the older of the two be the exector. This are not kid, The younger sister is 40 and ther was no reason to have any exector of this will. It was spilt between the two of them evenly. But with Theresa is control the younger sister can only get the amount Theresa convince her father into giving her. And wht will she not give her what the total was after the debts were paid and the balance now. What is she hiding?
What kind of sister does this to her flesh and blood. Theresa own this Title company a makes over 100,000 a year, Her yonger sister makes 21,000 and could of use this money to buy a small home or a down payment. Her sister has a car loan that could be paid off instead of her struggleing paycheck to paycheck. Can't contest past that stage. She will rot in hell someday trust me.

Is the father still alive? If so, the will has nothing to do with anything. He gets all the money from the sale, period. If he has died, then she can contest the will if she feels entitled to more. But if she does this, the attorneys fees will be taken out of the father's estate and it could drag on for years. Also, you said that she doesn't know the financials of the will, but you stated that she will get ten thousand a year. This is a contradiction. Which is it, does she know or doesn't she? And if he has died, then she HAS to be read the will. Usually this is done at the lawyers office. As far as the executor goes, someone does have to be executor, this is to ensure that the will is executed properly and as is written, so people don't jump on his stuff and scavenge it all. The executor's job is important and necessary. As long as father is of sound mind, he and only he, can make his will, so it is what he wants. The executor only executes the will.

When it comes to money, everyone should be on guard. Family everyday turn on each other in regards to money. I don't think it was right that Theresa's sister was not present at the time of will being done. It clearly shows that Theresa was up to something fishy and not knowing the amount and her balance clearly shows something not legal is going on. I would consult an attorney to look into this immediately.
