This rebuttal shall serve as Legal Notice to the subject ROR Report and for adequate “Notice” to the post Author named "David--Florida, USA".

Please take notice that Manuel Torres a/k/a Manny Torres (“Plaintiff”) has initiated an action in the Eleventh Judicial Circuit Court, in and for Miami-Dade County, Florida, case number 2018-000632-CA-01 (“the Action”), due to allegedly false statements made by “David – Florida USA”.  In the Action, Plaintiff seeks to subpoena the records of Xcentric Ventures, LLC for your identifying contact information to be sent to Cappiello Law PLLC at 5794 SW 40 Street, #108, Miami, Florida 33155.  Plaintiff has served a subpoena on Xcentric Ventures, LLC, the company that owns and operates this website, to reveal your identity.  You may have a right to file and serve a response to the subpoena anonymously.  If you intend to file and serve a response, please do so, or notify us of your intent to do so, on or before May 16, 2018 to Erika Cappiello, Esq. via email at:  erika@cappiellolaw.com or via facsimile 786-524-8000.

I, Manny Torres a/k/a Manuel Torres hereby respond to the subject post as follows:

The post about me is false and defamatory.  Below please find the reasons and explanations regarding why the information in the post is false and defamatory.  First, regarding the claim that my “Captain’s” license from Jamaica is fake or expired.  I don’t have a Captain’s license from Jamaica; never have.  I’ve never even been to Jamaica.   I’ve never wanted to visit Jamaica.  Therefore, I could never obtain a Captain’s License from Jamaica.  Additionally, I’ve never claimed to have a Jamaican Captain’s License, never wanted one, nor have I ever attempted to obtain a Captain’s License from Jamaica.  Again, I’ve never been to Jamaica and ALL of my professional licenses are from the United States, specifically the State of Florida.

I was not arrested in the mid-90’s related to missing maritime equipment.  I have never been arrested for or charged with missing maritime equipment.

I currently hold a valid and current State of Florida Employing Yacht Brokers License, upgraded from a previous State of Florida Yacht Salesman License.  Please see State of Florida Department of Business and Professional Regulation database.
