On February 5th, 2009 Mauricio Restrepo came into my business and had a consultation with me regarding installion of security cameras. He showed me two sets of cameras. I picked the first one (~$3400) and he requested a deposit of $1700. Two days later, I called him and told him that I was going to go with the second set of cameras (~$2400).


I requested that he should return the check of $1700 originally given to him. He called me by my name and said, "Don't worry about the check. It has been destroyed." Six months later (July 31st) he cashed the $1700 check. When I contacted him to find out what happened,  he told me it must have been an error from his office manager. He told me he would look into it and give me a call back.


A few minutes later, he called me to tell me that he was very sorry and he was going to make the deposit on Monday (August 3rd). After the 3rd, it was impossible to get a hold of him. When you called him his inbox was full; Callers were not able to leave any messages.


On Tuesday (August 4th) I called him repeatedly and couldn't reach him. On Wednesday he called me and told me he was at the bank and wanted my account number, which I gave him. Then on Thursday morning, I checked my account and the money was not there. I called him back and once again couldn't get a hold of him.


Thursday evening, he texted me to tell me that he was going to keep most of the money for not following through with the business deal. He said he would give me $500 dollars when he sells the equipment. That was the first time I heard that he purchased some equipment without my knowledge.


Overall his story changed. He told me that he would keep most of the money just to teach me a LESSON for not doing business with KVR.

He's really holding your deposit ransom.

I know that there are more than a few places that have a "restocking fee" that's usually about 10% of the total price of the merchandise, but this guy's gone way overboard. There's no way he should be dinging you for $1200 of your money, even if he had a restocking policy in place.

In reality, consumers change their minds all the time. It's not a crime. Perhaps you realized after the fact that you didn't need some features or something, or the overhead on the cams was just a little more than you wanted to swallow... Again, not a crime, and really shouldn't be a big deal.

This is really, really poor business sense. What he should have perhaps (in my opinion) done is this:

There's a $1000 difference between the set ups. He should have offered to take the $1700 you gave him and apply it to the deposit and purchase of the lower end equipment. In other words, if the deposit would have been lower for the cheaper stuff, put whatever that deposit amount is on the equipment, and then anything over and above that left over from the $1700 directly against the main purchase price.

Was there any clause in anything you signed that looked even remotely like restock charge language? If not, he certainly cannot arbitrarily just enact something like that, surely. It must be illegal.

it strikes me that this guy is acting merely like a petulant child who is all butthurt that he didn't get the commission off the sale fo the higher priced items, and has thrown any and all common sense out the window. Please correct me if I've misinterpreted the situation.
