I rented a house to Mark and Deborah Gilim ion Feb or 2011.  They paid the first and second month's rent and after that they sporadically paid at their will,,,IN April they claimed that Deborah has breast cancer so I let them pay late and from then on they paid when they wanted and how much and if they wanted,  I took then to court in August and at their lawyer's request and against my better judgment I agreed to a consent judgment with them paying an additional $200 per month to make up what was owed.  Their first payment check bounced at which point I should have evicted but I didn't.  For the next 6 months they continued paying what they wanted and when they wanted and if.  I filed again in court for an eviction and they got a church to pay me almost the amount that was owed.  We went to ccourt in Feb and I won the judegment.  The sheriff called the day before eviction stating there was an appeal on the case and they couldn't evict.  We went back to court in March and they requested an extension for a week for get an attorney.  We went back to court the following week and they did not show.  The judge found in my favor.  They immediately filed for her to vacate her judgment since they were in the wrong courtroom...funny how the rest of us managed to get to the right room.  I hired an attorney to cancel all the crap they were throwing and the judge  instead of granting it to me ordered yet another hearing.  We went to court once again and they said they would pay and we all signed a consent judgment.  From that day in court they never paid another month's rent and I took them back to court yet again and they claimed the wife had a recurrance of her breast cancer and they needed two more weeks to come up with the $4700 they owed me...they were woriking with agencies to get the noney.  LIke an idiot I gave then the two weeks and never received a plug nickel....they gave since moved out, trashed the house, changed their phone numbers and have created a situation for me where I will lose my house to foreclosure...which they knew was a possibility when the I said it in courty and the judge warned them to not let me lose my house.

 

They have played both me and the court like a fiddle...suire this was not the first time they have done this and I am sure they are setting up someone else right now to do it again.  I can't report them to credit bureaus becasuse I am not a member so I am filing a report here in hopes that their next potential viction might do a search and them and see what I have been put through.

Rebuttal to Landlord's Misrepresentation

I am the subject of this report and although I have been vindicated by the courts and my claims legally upheld, this despicable individual felt the need to falsely make claims, so I will respond. Any claims put forth by me can be independently verified and all one needs to do is follow the procedure here on this site to reach me for said verification. It will be provided as requested as needed by any legal or law enforcement entity.

The landlord in question, Ms. Lois Fox, rented a home to us and stragically both misrepresented the status of her ownership, and the fact that she had tried the same type of stunts with the previous renters of the home. After we had been in the home several months, notices began to appear from the bank/finance company (Citimortgage) for forclosure. We learned from the bank that this was not the first time this had occurred with Ms. Fox.

I shrug off the insinuation that there was no cancer. I think a mastectomy, several rounds of chemotherapy, radiation therapy,hormone therapy, and any number of physicians will gladly attest to any medical questions. Again, this is readily available if needed. There were late payments made because of the situation, but nothing nearly as egregious as Ms. Fox states and again, all receipts and deposit slips are available upon request.

In making the attempt to pay rent due, I paid Ms. Fox a lump sum to be applied toward the current rent as we had an injunction from the Court and subsequent agreement and arrangements from Ms. Fox to catch up any past due amount. She obviously was NOT expecting this as she simultaneously began legal procedures for eviction. This was after a lump sum payment of over $2000.00 with the instructions it be applied to current charges with any balance to follow. She chose to misrepresent her situation to the court in an effort to remove me and in my opinon, rent at a higher price than in my lease.

She then came to court claiming she was owed even more, which was not the case or the way I sent the funds, and I have the actual letters and documentation sent her. What probably shcked her more, she learned later, that to pursue the matter, I made full payment to the Court of every penny she had demanded. Any lawyer will tell you in order to pursue a case, any disputed funds have to be rendered UP FRONT.

I continued to make payment each month - not to Ms. Fox, but directly to the Court. After several more appearances and finally having a judge listen to both sides of the story in open court, the Court determined there was no basis to her claims and demands because from Day 1 I had paid all the funds into the Court registry.

i will not dignify her malicious and angry claims and retorts other than to say I have just learned of this on Ripoff and rebutted to keep the record straight. Her attitude is what happens when you lose in Court with a team of lawyers to a single, determined individual who would not be taken advantage of. Any statements or claims made by me can be fully documented and as stated provided to any relevant party. Lois, you lied and tried to evict us, and you lost, big time. Deal with it, live with it. Keep lying, and I will be there every step of the way to correct the record. You lied when I paid you AND YOU TRIED TO PLAY THE VICTIM IN COURT AND MISREPRESENT THERE TOO. IT DIDN'T WORK. GET OVER IT AND GET A LIFE. As you so succinctly stated, I hope others read this so you cannot do it again.
