My vehicle was hit by an insured driver of (MAIF) #T933291


Please note the facts below related to the auto accident between the "MAIF Insured Person and my vehicle:
1.Driver at fault drove his vehicle across a Solid Line to pass a Public Transportation Bus that had come to a complete stop as passengers exited the Bus onto the street.
2.In order to take the above action, At Fault Driver drove his car into the lane of the ongoing traffic ignoring the solid line/ do not pass condition.
3.My vehicle had come to a complete stop (Stop Sign) and cleared the path to move forward and proceeded to cross the intersection in front of the Bus.
4.Driver at fault came from behind the bus and struck my vehicle creating
damage that rendered my vehicle immobile.
5.MAIF impounded my vehicle and held it for review without offering any arrangement to provide transportation which I needed immediately to continue my employment. MAIF still has possession to date.
6.After repeated attempts to get transportation assistance, I rented an auto and incurred auto rental expenses which I needed in order to meet my obligations to my Customer.
7.On 4/23/08, I was informed that my auto accident claim had been denied by MAIF even in light of the Police Accident Report in which at fault driver was charged with causing the accident (violating a solid line/no pass condition).

So my vehicle is totaled and my claim has been denied. I had only liability insurance on my 1998 Ford Ranger, So this mean I am at a lost. One thing is certain I'm Glad I am not insured with (MAIF) because if they will aviod paying me when their driver is at fault "What else will they do to avoid paying"

I have contacted the Maryland Insurance Commission about this lude act and I'm praying that they will be able to help. If anyone would like a copy of the accident report that clearly shows MAIF driver was at fault, I will gladly send you a copy upon request.

The insurance company does NOT have the final say. You can still take the driver to court personally for your damages. If you have the police report and if the circumstances show that they were at fault the judge would rule in your favor.

You will have to do some legwork in getting several estimates as well as be sure you keep all of your receipts.

The other driver will attempt to show that the insurance denied the claim so that is it, but a judge is not bound by what an insurance adjuster says. That is unless you have signed any documents with the insurance company that stops any further proceedings.


BTW what was the reason that MAIF gave you for denying your claim?
