Over the past three years the Maryland Insurance Administration has been presented three complaints against Midland National Life Insurance Company detailing serious allegations of threats and intimidation against a policy holder and his family.  The insured also presented compelling evidence that Midland National had committed billing fraud in an effort to lapse the policy of the person they have threatened.

Midland National responded to these allegations with false statements and excuses that no competent investigator should have ever taken seriously.   The Maryland Insurance Administration failed to conduct an objective investigation and has compromised their own review process by sending the insured the wrong forms to process the complaint.  By simply Googling “Midland National Life” reputation they would have enough information to open an investigation of Midland National.

Is this basic ineptitude by the Maryland Insurance Administration or a conflict of interest by Maryland Insurance Administration employees that are looking forward to cushy jobs in the life insurance industry when they leave public service?  The Baltimore Sun recently reported allegations of conflict of interest by Maryland Insurance Administration employees that cost tax payers hundreds of thousands of dollars or more.

If the Maryland Insurance Administration has conducted any form of competent investigation into Midland National Life they would have learned that in federal court filing on December 19, 2014 Midland National Life abandoned their long standing denial of threatening the policy holder that had filed the complaint by changing their position to one of silence.  Faced with overwhelming evidence of state and federal crimes Midland National, in effect, exercised their rights under the Fifth Amendment of the United States Constitution – the right to remain silent to avoid incrimination.  Midland National was given an opportunity to clarify their position; however, they declined (Castaneira v. Midland CIV. 10 – 4039).

It will be interesting to see whether the Maryland Insurance Administration finally conducts a meaningful investigation of Midland National Life now that all of the facts are before them.
