Massage Envy After canceling account they refused to honor 3 massages I had already paid for and they would not refund the money. I had a fourth payment taken out of my account and I did receive a refund on only that payment. Nampa Idaho

I signed up for one year of massages.  I was under the impression that my contract expired on 11/28/2013 but I had another payment taken out after that.  ( a total of 13 payments) I called them to find out why I had another payment come out and found out the contract has another statement that after the initial term of the contract it continues on a month to month basis until cancelled.  i am confused at the terminalogy of it saying it expires on a certain date but then saying it continues until cancelled.  I interpreted it to mean it was over on the date specified as the expiration date.

After I canceled the contract I was told they would not honor the three massages I had already paid for and that she was canceling those massages and I would not get a refund.  I dont know how she could cancel those.  I had them coming. I had been ill and unable to have them in September, October and November.  She did refund the last payment they took out of my bank account after i told her I wanted the last payment they took out of my account put back.

i think there is two things wrong here,  the first being the wording on the contract of EXPIRE on a certain date and second canceling the massages I have already paid for.  I think they owe me $132.00 for those massages they are not honoring?

 You acted in haste and now get to repent at your leisure. The wording in the contract probably states that this contracts term limit expires on 11/28/13. That means that BOTH parties are free from the terms and conditions set forth in the contract on that date. Meaning that until the time expires on it, you are locked in untill 11.28/13. It wont say that your MEMBERSHIP would expire, just the terms that both parties agreed on.

Hers the problem for you, YOU CANCELLED!!! Once you cancelled, it wouldnt matter that you had services prepaid. By cancelling you are saying that YOU are no longer a customer and no longer wish to do business with them. YOU gave up your free massages. Had you just waited until you had recieved your massages, then cancelled, you wouldnt be in this position. I agree that its not fair, but it isnt illegal or unethical. You chose to no longer deal with them, that means that they are under NO LEGAL OBLIGATION to provide ANY services, prepaid or not.

You can try and fight them on this but you wont get very far. Your best bet would be to take them to small claims court, but thats more money and time that you will have to spend. When they show the judge or mediator that you cancelled your MEMBERSHIP, and then demanded the services, they will probably dismiss the case.

Its called having your cake and eating it too. In this instance its not going to happen. Its unfortunate that you are going through this but it WAS brought on by YOUR choices. YOU chose to cancel, past that, there is no real help for your situation. You should have demanded a refund BEFORE you cancelled. Once you cancelled you pretty much tied your own hands.

The American Consumer has so beaten and abused the business world that NOW they ONLY do what they have to legally. This means all the nicities that you get used to are slowly being taken away. Those nicities cost money and time. Two things that businesses cant afford to lose. You MIGHT be able to get them to take you back, but Im 100% sure they have processed the paperwork already, and given the general tone of your own post, I doubt you were sweetness and kindness when you cancelled your membership. So they probably wont take you back.

In the future, DONT CANCEL!!! Wait to be sure youre not screwing yourself over by acting in haste!! Take a few mins and walk away. Think about the ramifications of your choices BEFORE you make them.

As a producer for a nationaly-syndicated television show, I went on assignment to the headquater's of One Source Talent in Troy,MI located in one of the wealthiest areas of Michigan. It came to my attention that the former con-artist's behind the "Wilhelmina Scouting Network" scam, (not to be confused with Wilhelmina Models in NYC) were conning people again with a new twist, modeling consultation under the guise of modeling promotion. The crafty sceam developed with the pseudo-open call. 

The office manager, Christina, played "the devil wear's prada" on a flat screen TV, while aggressively pursued applicants wait to hear a better-than attitude to ploy people into the con. She even invited people to leave if they were not up for the demands of the industry. She mentioned names of people One Source allegedly elevated to levels of working models and superstars like, Diamond White on Broadway. 

Everyone should know that nobody needs to be consulted in the industry of modeling unless it is a legitimate agency, and even then, there is no model's union with codes and standards for this business. I was asked to sign with the company to be promoted to authentic modeling and talent agencies. One Source Claims to cast reality shows and local events. The truth is the information on castings is available to anyone who knows where to look. 

My company and an undercover asscociate disguised as my gay-lover, went in to the second interview only to be told what celebrities we looked like by a naive teenaged employee. 

As I dug deeper, I was asked to get photographs taken by the in-house photographer to the tune of $900.00 plus the intial fee of $395 and the $30 monthly fee for the "My-space for Models" website that is inaccessible to the public. I followed their orders, and confirmed the con while gathering more evidence for the TV show. The catalyst was the overwieght, long black hair and overly-injected lips of the VP, Katie Ludwig. 

She described when she first met me, I was too gay to make it in this industry, too gay to be sent out 
on jobs and I need to butch it up for fashion cause the gay designers only want what they cannot have. I personaly am not gay, however I have many gay friends who who work in all parts of the entertainment field, this is where I drew the line. One Source is still unaware that we are working on a nationaly syndicated TV show about modeling scams, however, we hope to shed light on this covert exploitation of innocent people who have dreams of making it big. 

Note: OneSourceTalent and Ms. Katie Ludwig, brother Kevin Ludwig, and owner Anthony Toma are master con-artists out for your hard earned money. They will try to intimidate and take a one-up position to allegedly help anyone become famous. Never, ever pay any "modeling agency" up front money. Agencies make money when the Model makes money and any costs will be deducted from that model's paycheck. This is industry standard. Until the TV show airs, Please be aware of the onesourcetalent.com scam!!
