Mattreess 1 One Failure to deliver product that I paid for Ft. Lauderdale, Florida

On 12/22/11 I purchased a Temperpedic Cloud Lux king sized mattress from Mattress 1, the salesman Johnathan told me that Temperpedic had a 90 day trial and if I was not happy I could get a full refund.     After just a few days I was unhappy with the mattress, and returned to Mattress 1 only to be told I should give it a little more time, since it was a 90 day trial, I should wait at least 60 days.

I returned on Feb 10 and found that Johnathan was "no longer with the company" and there was no refund, even though Johnathan had written on the receipt "90 day free trial".  I was given the number of Customer service and should talk with Martha.  She told me again that there was no refunds with their company.  When I threatened to call my credit card company (even though they had already told me they would not refund the money), plus the fact that Mattress 1 did not charge sales tax, and when I threatened to call the tax department, she told me they would do an exchange for a less expesive mattress and give me a refund.

The delivery of the new mattress was scheduled for 2/25/12, but they never showed up.  I called and was told they would have to reschedule for Wednesday 2/29/12, when they did not show up by 3 P.M. I called and was told that the mattress was on a truck for delivery.  I waited and then got a call from the store saying the mattress was out of stock and they would have to reschedule the delivery and they would call me before the end of day 2/29/12.  Guess what?  No call and now when I call they do not answer the phone.

It is apparent that they have no intention of delivering a mattress since they know I am stuck with the unwanted Temperpedic.
