Mr. Marc in finance approval dept at Max Madsen Mitsubishi, please note I was in your Max Madsen Mitsubishi location in Aurora, Illinois on Saturday 11-29-08, and assigned to a "Black Salesman" who spent time running back and forth receiving instructions from the management staff at this Aurora, Illinois location. The three hours spent at this car dealership was to receive approved credit to purchase a vehicle and trade in my current vehicle. My application was denied because I would not contribute $1300 for a down payment. I owed around $4700 for my current vehicle, which would have created a up-side-down car loan. Your website said that you assist consumers that currently have a bankrupty, but that statement is not true.

Not once did anyone from your finance organization come to me and say let's talk about your current financial status. You had a salesperson that had been on the job for (3) days, who did not quite understand how to use your computer system to insert my information and print the information.

Instead of having a co-work come and sit the new salesman and assist your "Black" employee you allowed him to run back and forth asking questions concerning my application process.

I came to your dealership back in 2006 and received the same negative salesman assistance, where after I could not come up with $500 down payment, your salesman continued to run my credit history to various bank vendors as if I was coming weekly looking to have a car financed for me by Max Madsen Mitsubishi. This information can be proved by copies of my credit reports.

The car dealers are not seeking financial relief because of people like me.they are seeking relief because of the deals made to people who are dishonest, and claim to have good credit, (when in reality they do not have good credit.) There information is fuged to make it appear everything is in order of which many car dealers will false consumers information to make a car sale, and tack on extra for the salesman.

Your General Manager listened to my situation but did not believe my situation was valid after reviewing my credit report. I don't have over $100,000 in debt nor did any of the salesman review my credit report, or spoke with in person concerning my vehicle trade. Only the saleman Mr. Wil Beard asked me for $1300 down and no trade for my car.

I filed a chapter 13 in 2005 to save my condo to keep it, and pay outstanding hospital bills. What looked bad on paper as you well know is unforeseen circumstances that we all have during life's challenges to live. My situation is no different from other men and women. I chose to pay towards my immediate debts. Living on $1000 a month could not be done by you or employees of Max Madsen Mitsubishi. Yes I could have filed a chapter 7 to get rid of all bills and lose my condo, but I am not like most consumers to get out of total debt.

I chose to pay towards my debt because I made the debt. I've been paying for (2) cars since 2006. One that's currently in my chapter 13 and one that is not currently in my chapter 13. I am also current with my current vehicle that is not listed in my chapter 13. Also it did not matter that I've paid almost $53,000 towards my current chapter 13 since 2005, which will be paid in full in July of 2009 as long as I continue to be employed.

I expect to receive a declined letter from Max Madsen Mitsubishi in a week or so (even thought I did not speak with anyone acept the salesman) that reviewed my application with the general manager of this Max Madsen Mitsubishi location. The owner of Max madsen Mitsubishi was sitting in his office the morning I applied for a "used" vehicle 2004. I will forward a compliant with the better business bureau with a scanned attached copy of your declined credit letter once it arrives.

I thank everyone at Max Madsen Mitsubishi who knew all along that they were not going to allow me to secure a "used" Mitsubishi vehicle. God helps those who help themselves in an honest way. Your salesman Mr. Wil Beard knew I could not afford $1300 to put down on a car only to go into his pocket. I did realize I had an up-side-down situation with a balance. I've known people with bad credit to have as much as $10,000 and more of outstand car debt, and was still able to secure new cars, and they were white consumers. I'm sure Mr. Beard could not live off $1000 a month to survive weekly while daily earnings are taken to pay for debt.

The facts of the matter are that you have derogatory credit and are currently under a Chapter 13. The first step should have for the trustee to be contacted and a letter provided stating that the new loan would not also become part of the chapter 13. Even if there was a letter I would still have declined you.

Second if you only have 1000.00 per month income I would have declined you for insufficient income no matter how good your credit is. Not only most there be a good credit file but also the capcity to repay the loan.

Third, get off the black/white issue. Your loan being declined has nothing to do with skin color it has to do with your bad credit. As a lender I don't care what race, religion, sex and right on down the list, what I do care about is for that person(s) to be able to pay me back within the terms of the loan.


The dealership did help you by trying to get you a car loan by submitting your application to various lenders. The thought that there may have been a lender that would have considered your loan for 1300.00 down is amazing.

As for your comments on finacial relief, In most cases dealerships do not finance consumer loans, financial institutions do and many lenders are having many defaulted loans from people just like you, the people who say it is the other person who will not pay.

As for submitting to the BBB. What for? Face it you have derogatory credit. Your denial letter will most likely say you were declined due to Bankruptcy, derogatory credit, and insufficient income.

First your title is very misleading, you are not a minor. A minor is someone under 18 and you already have a car loan and have been through Bankruptcy. Based on how you refer to the Salesperson it seems as if you have other issues that you need to deal with.

But just looking at your situation there does not appear to be any ripoff except perhaps what you are trying to do. You are currently in a repayment plan of a Chapter 13 Bankruptcy, and have TWO cars. You are trying to trade in a car that you are upside down on, and are upset because they want you to put down $1300 in cash. You need to take a step back and really think about how this sounds.

I hope that you have kept your Trustee aware of everything you are doing and got approval from them. Because if the Trustee ever reviews your case, and with the repayment plan ending in a few months that is a good possibility. If they see you have 2 cars and have applied for additional loans they at the very least will review your Bankruptcy. At which time they could require additional payments, or at worst file a motion to have your BK dismissed.

You won't receive a letter from the dealer, but the bank(s) they submitted the application to. Oh the reason they kept submitting your information to various banks is because every bank they submited your application to DECLINED you.
