My truck was booted for parking in a loading dock area behind a Big Box store while I was in the vehicle. My issues are 2 fold. First is the practice of booting vehicles while the vehicle is occupied. Second is the business practice of this company. After researching Georgia law, I have found numerous illegal practices that they employ . First is the signage, no company name is listed and no fine about is listed. The sign aren't in close proximity to the location in which I was booted. Lastly the fine was ridiculous: $510.00 to have the boot removed. I will not name the store but will tell you this took place in Conyers,Ga.

Booters and towing companies regularily violate the law when performing this so called "Parking Enforcement". The towing of an occupied truck is illegal. Period. End of story. So, why do you think that it is legal to BOOT an occupied truck? It SHOULDN'T be. There are trespass laws that describe how property owners can deal with tresspassing but there is no monaey in that for you booters because it involves TOWING. Most booters don't even have their own heavy duty tow trucks. So you BOOT because it allows you to sieze a persons truck and cargo, WHILE the driver is in possession of the vehicle. 

The first thing that a person who is booted should do is check to see if there is an ordinance in their booted jurisdiction. If there is, take out a tape measure and check the signage for compliance. If the signs are NOT compliant, call the police and aske to have the boots removes as the company is not abiding by the boot laws.

If there is no ordinance (which is happening all over georgia) insist that they have to defer to the trespass and towing laws of the state. Note that you are in posession of your truck and that you shoulld be warned, notifieed and released without a stupid boot fee. Insist to law enforcement that in the absense of a booting law, rule or ordinance, that the trespass and towing laws prevail and that booting is actually extortion. Good luck.

Let me take a wild guess here...

You weren't delivering your trailer to this "Big Box" store..were you? 

Now, I do believe you that you were in your cab when they booted you.  As you were in your cab...SLEEPING.  Yep..nailed it.

Here is what really happened.  You figured that since you were a Semi you have the right to go onto some businesses property and park in THEIR loading dock area UNAUTHORIZED.   Obviously this loading dock is big enough and they have enough of an issue of this(I bet it is right off the freeway) that they had to hire a company to patrol the area.

Oh and here is a thought...what if you really blocked them from either moving in or moving out another trailer..the lost labor alone they could charge you with probably would have exceeded the "fine" by 2 or 3 times.

How do I know this is all true..if you had a valid business reason to have been there the "Big Box" store and/or your company would clear this up.  If it was their merchandise you would be mentioning the "Big Box" store that failed to help you when
