These guys are unbelievable. I'm a contractor and bought a Dewalt nail gun for a project. These guys sent it Fedex no signature required. Fedex guy leaves it outside my gate and it's predictably stolen. I call them and say I would never agree to have anything left no signature required and wasn't given the option when ordering tool online. They ask me to file a police report which I do so that I can get a replacement. I call them with the report # and they say no they aren't going to send me a replacement. They took my money, wasted my time, and stupidly told fedex they could leave an over $200 item outside my gate with no signature. Best part was Melissa Gonzalez at Maxtool asked me if I followed up on my police report to see if they found the perpetrator. As if this petty crime was right at the top of Tucson Police Departments priority list. AVOID these guys. Worst part of this whole drama is how much of my time was wasted dealing with them and their sending me on the pointless wild goose chase with the police department.

Unfortunately, Maxtool tends to do business this way. Some bad comments on Yelp and EBay. Shortsighted business practices for sure as contractors like me spend a huge amount on tools. Great job Maxtool you got my $200 and now will never get any more of my business and I'm sure this will scare off others.

The signature for a deliver, like an declared value insurance, is the shippers choice. Though the sender has the prerogative to charge for these services, it has nothing to do with the recipient's liability.
Playing the devil's advocate, let's assume you have the package right in your living room and lied about receiving it. It is still the senders responsibility to prove delivery. If the receiver states it was stolen, misdelivered, or is at his address without his/her knowledge, it is still the sender's responsibility. The sender can not prove it was properly delivered, therefor the sender is liable.
It's rather pathetic that this sender, maxtool.com is dumping the responsibility on you. Sussegting that you contact the police is absurd and a copout only wasting other people's time for maxtool.com incompetence. The only action maxtool.com can take it to contact FeDex for THEIR shipment and request a tracer. If nothing turns up for THEIR shipment, then FeDex would reimburse for the shipment and any insurance that maxtool.com placed on it. Regardless, if maxtool.com does not send a replacement, it is not only irresponsibility but also theft on their part.
Incidentally, UPS has GPS coodinates for all deliveries. If those coordinates show it was delivered to the proper address, no loss claim is valid. If theft actually did occur AFTER delivery, no carrier is liable.
