I bought two horses from JoAnne MacKinnon of Mb Horse Finder in September, 2004. She deposited my $1700 check in her credit union on 10/18. She was supposed to bring the horses down to CA in December 2004. I paid her $150 for shipping fees in December 2004.
On 12/20/04 I got an email telling me the horses were not being shipped and the farmer was keeping the money.
She asked me in several emails to give her 2-4 weeks to refund my money. I have several emails from her promising a prompt refund. I gave her until 1/31/05 to pay me back. I emailed her on 1/26/05 asking if my refund was ready and have not heard from her since. She refuses to return my pleas for my refund.
She is now bragging in her latest newsletter that she has sold 500 horses and all of them went to homes. Balogna. I didn't get my two from her and she STILL has my $1850.
She never showed me any proof that she paid the farmer my money. He claims she never did, that's why he would not ship the horses. NAERIC told me that they have complaints against her a mile long and have her on "permanent hold" so she doesn't get any more subsidies from them.
I have all the documentation necessary to prove my case, including cancelled check, paypal receipt for shipping fees and emails promising a "prompt" refund...which never materialized.

Still No Satisfaction

It is now August, 2006 and I still have not received any more refund since the initial payment made to me in April 05 of $400. I am still owed $1450.00.
I have received almost two years' worth of excuses and now Joanne MacKinnon has disappeared from the internet, her website is deleted, her old phone number hasn't worked since January, 06. I wrote to her on 1/22/06 and got an answer on 3/9/06.
She made yet more excuses and promises that "as soon as she sells the farms" she will refund my money. I have begged and begged her to take the farmer who she says she paid to court to get my money back since he kept the horses and all I get is stall tactics and excuses. She says the RCMP has declared this case to be "civil" yet they have never contacted me personally, even though they have all my contact information.
This case is going to be 2 years old in December, 06 and I am tired of patiently waiting for the balance due of $1450.00.
She and/or the farmer, Mr. Mooney, should be held accountable for taking my money and not delivering the horses I bought.

The customer who ordered the horse sent her payment to me, the payment was appropriately given to the farmer who had the horse for sale, as per our standard practice.
Days before the horses were to leave for CA, the farmer declared an unsubstantiated underpayment and chose not to realease the horses for delivery.
To date the farmer has not substantiated his claims but will not refund the buyers money. I have provided the buyers whose money he accepted, with copies of the statement in where he acknowledges their payments received by him.
I am pursueing legal action against the farmer, however in the meantime, I am attempting to personally pay back the buyer for their horses. I do not have the resources to do so outright and I am working with the buyers to settle this matter in a timely manner.

As of March 30, 2005, Joanne MacKinnon has contacted me and we have worked out a payment arrangement. I received my first payment toward the total due of $1850 and will be receiving regular payments until the debt is paid.
Joanne MacKinnon has been very cooperative and is eager to settle this transaction with me. I appreciate her efforts very much.
