In December 2012 I spent a whole week looking for a new car for my mother. Her credit was not that great ( a 590) and she had a little bit of money down... around 1,000.

I knew an old buddy that worked at McCombs Ford West who was able to help my brother get a car with not so great credit.

SMALL DETAILS TO REMEMBER: My mother has been at her full time job for 11 years. During the search she had a week off due to surgery so she was on short term disability but still getting paid a percentage.

We went to McCombs Ford West to meet up with the sales men who showed us a nice older Honda in great condition right in her price range.

We decided to apply for the vehicle and disclosed to the sales men all the detail. He mentioned it may be hard to get her approved due to the fact she is not getting paid 100% right now, but that he would try anyways.

After about an hour of back and forth he came back and let us know that she was APPROVED!! BUT she had to come up with another thousand dollars. So we scrambled, but I did not want my mother riding the bus. We came up with the money and off she drove. Accepting the horrible interest rate and the higher price of the car, knowing her credit wasnt great.

FAST FOWARD TO Jan 22, 2013: My mother got a call last week. The loan was not approved, she had been driving a car she thought was her and never was. She got insurance on a car that wasn't hers.  The finance manager said: You have to come in and re apply because your loan never got approved but it should be no big deal.

So she re applies: They called my mother to tell her she was NOT APPROVED for the loan and the only way she would get approved is if she brings another $1,000 dollars to total $3,000! 

Even though she has a contract in her hand stating the car was hers upon regular payments of ex amount at ex amount of interest the dealer wants more money because THEY FAILED TO GET APPROVAL! 

They say they want to make it right but DON'T.  This is an instance where they should have just bit the bullet on their mistake, lowered the price of the car and ate the money they lost for their incompetent sales men. They are the ones who advised my mother to put her regular income on her original application, then called her a liar when they couldn't verify because she was on short term disability. YOUR FINANCING BANK CAUGHT YOU TRYING TO PULL A FAST ONE, IT SHOULDN'T BE YOUR CUSTOMERS FAULT!!

Not so fast

That really has nothing to do with the SECOND time she went in and put accurate info in. The contract she has is from the SECOND time she signed. The contract states the money she put down, what her payment and interest would be etc.

So in this sales contract it says they are agreeing to financing her. Not her fault they couldn't get the financing. 

They sent paycheck stubs that were up to date. Why have her sign a contract that binds her when they can't bind themselves?

I'm sure if she turned around and said you know what I change my mind... she wouldn't have such an easy time taking the car back and getting her money.

It's now their responsibility to find financing or lower the price of the car. There is no clause in her signed contract that states upon credit approval this contract is binding.

    Who signed the application attesting that the information in it was true?   I'll bet it wasn't the salesman.    Your mother should have never agreed to signing an application that did not show an accurate income.   That is considered bank fraud in many jurisdictions.  When they prosecute it, they only go after the person who signed the phony application.   

   Sounds like your mother knew the info wasn't exactly true and was also trying to pull a fast one on the lender.   She got caught and this is the result.    

   Seems like no one is responsible for their own behavior anymore.    In the old days it used to be your mother that taught you to own up to your mistakes.
