To Whom It May Concern:

Please allow this to serve as a formal complaint against the above-mentioned person and her agent, partner or employee, Linda Mula. After multiple attempts to persuade Ms. Mercy to comply with the contract we have signed and to follow through on the things she has said she would do, I have no other recourse but to seek assistance in this matter. Let me allowed to warn others that Mercy Cepeda has failed to fully meet her obligations, and has done so at great inconvenience to my family and myself.

There was a recent death in our family and from that we hired an estate sales company Ms. Mercy's Antique's, from Morgan City, LA, to conduct the sale. The sale occurred on March 14 15, 2008. Ms. Mercy and her crew had been on site for 2 days prior cleaning and arranging items. The estate sale occurred and many items were left over. A contract was signed with Mercy Cepeda on March 20, 2008. That document is a consignment agreement between Ms Mercy's antiques and family and states the following:

This agreement of consignment is between Ms Mercy's Antiques, WE' and the person or persons YOU' undersigned, and have agreed on the following.

We will take on the items listed and will sell at the price agree. We will take 25% of the items sold from the listed or reduce price item was sold at.

Checks for the items that have been sold are written once a month on the 5th of the month, at that time it can be mailed or be picked up at our store.
Every item will be given a number and a location, we will furnished you with a complete inventory, and a monthly print out of what has been sold along with your check.

If the items are not sold within 6 months they will be taken to auction.

complaint with this company is that the contract has not been honored. We have not received a completed inventory of items taken from or sold at the estate sale. Ms Cepeda has informed us some items have been sold and a check was in the mail, twice, but that check had yet to arrive until May 9, 2008. The date on the check and the postmark indicates discrepancies between when she said the checks were sent and when one actually arrived. Her check was not honored by her bank. As to the inventory, which we have been desperately seeking due to time constraints for settlement of the estate, she has sent one, barely legible, handwritten document without prices. We accepted this as a place to start but have expected Ms Mercy's Antiques to provide a complete inventory as per the contract, which she has not despite numerous emails and phone calls requesting such. She did send one other inventory, which was more legible but was still incomplete. The owner Ms Mercy to this date has been basically non-communicative and has marginally completed any of the requests to settle this issue.

We, as a family, do not want such a deception to happen to another grieving family. If there is any assistance you can provide, or any other persons we can notify please let us know. If you need any additional information as in a timeline or transcript of emails please let us know and we can provide.
