Mermaid Pools of Texas Warranty Fraud. Mermaid Pools of Texas does not honor their warranty! Hurst, Texas

   My home was purchased in March of 2000 with a Mermaid Pool installed 8 months prior.  We bought this home because Mermaid Pools offered a one time transferable lifetime structural warranty.  Stating in the warranty letter that the pool will remain structurally sound for the time that we own the pool. 

  Within a few months of owning this pool, a large crack started in the gunite just below the elevated hot tub.  Mermaid Pools sent a Contractor to "cosmetically seal" this crack.  For the next 7 years, Mermaid Pools sent no less than 3 different Contractors to "cosmetically seal" the cracks.  The Owner of Mermaid Pools never came out to look at the issue, only sending crack repair companies hired by him to "cosmetically seal" them.  I was told by each crack repairman that what Mermaid Pools was doing was not right and the pool needed much more attention then what he was doing.

   In 2007, Mermaid Pools sent a Contractor to jack hammer the biggest cracks, install re bar and re patch.  At this time, they replastered the pool.  Within 2-3 months, the same cracks had reopened and started leaking again.  Mermaid Pools sent another Contractor out to jack hammer the same areas and add additional re bar and reseal.  In 2008, more cracks opened and they sent another Contractor to my house to seal those. 

   Presently, I have at least 5 large cracks, the pool is leaking at a rate of 1/4" inch a day and the problem was reported to Mermaid Pools over a week ago and the Owner will not respond.  I hired a Structural Engineer to prove the pool is not structurally sound.  He informed me the repairs that were made in 2007 (I have pictures)were band aids to a much larger problem.  I can not sell my house with the pool in the shape it's currently in.  I've tried over the last 9 years to have this pool fixed properly so that the pool can stabilize and stop cracking.  At one point, I was told by the Owner of Mermaid Pools that his only responsibility to my pool was that it hold water.  Mermaid Pools should be held liable for the Warranty they issued.
