I was looking for the car of my dreams on Craigslist. It was a 2002 Cadillac Escalade listed by Metrolina Autohaus. I applied online and was approved. I was contacted iniatially by Patrick the Finance Manager whom gave me more details regarding the truck. He told me that I needed to put $3000 down but I only had $1000. The following week I received another call from the General Manager, Dame informing me that I could layway the Cadillac Escallade. So on 9/25/2010 I gave Dame $500 towards my $3000 down payment. He gave me a receipt. So over the next 4 months I continued to give him money totaling $1,300.
I was unable to go pick the truck up on Monday so on Tuesday, 2/1/2011 I called the office and left a message for Dame to call me back. He didn't call back so on 2/2/2011 I called the office again and I spoke the Dame. He informed me that my car was being serviced but I would need to fill out another application and give him updated check stubbs. So I gave him my fax # but never received the application, so on 2/3/11 I went to Metrolina Autohaus. James another car salesman informed me that Dame was not going to be in the office for 2 weeks, but he would find out what was going on and call me on 2/4/11.
On 2/4/11 I called James and he told me that I could come and pick up my money on Sat. 2/5/11.
I was not satisfied with just getting my money back, because I am a single mother and I need a car. I have sacrificed this $1300 and I have been treated unfairly and this company has taken advantage of me. I want justice! The law is supposed to protect consumers from companies like this that use fraudulent, deceptive, and misleading tactics when conducting business. This is unfair!!!

I did a Vin check on the 2002 Escalade and found out that it went to an auction in December. Then it was sold to another Auto dealer in Deep Gap, NC. So I applied and was pproved. I drove 2 hours to get my Dream truck!!!!!

This report is wrong on so many levels that I don't know where to start. I guess I'll start by saying I'm not sure how you've been ripped off.
OK, you are a single mother needing a car. (I'll admit I hate when people pull out the kid card) It Sounds like you may not have the best of credit, or else you could have gone to your bank and obtained a loan. You also didn't have a decent down payment and it appears that the company was willing to work with you. If you had $1,000, why did you only give them $500 to begin with. Having said that, there was probably a time period that they expected you to perform in. You managed to come up with less than 1/2 of the agreed upon down payment in 4 months. How long are they supposed to sit on this vehicle. It costs them money every month that they keep it in inventory.
I'm sure they got tired of dealing with you and wanted to get this vehicle off of their lot. I don't blame them in the least after 4 months. If they gave you your $1,300 back, how exactly were you ripped-off? It sounds like they were the party that suffered damages (keeping a vehicle in stock for as long as they did).
