Back in 2001 my wife and I purchased a commercial property. Along the way our original bank sold the loan to First National Bank of Grant Park. Unfortunately FNBGP then sold out to Midland Bank. Which brings me to the purpose of my complaint. Midland has been despicable from the beginning. Last year I deposited $1200.00 cash in our Midland checking account to cover a very important $1000.00 check. My wife checked the account continually watching for the check to clear. It did. Then the next day Midland automatically withdrew $700.00 to cover a late mortgage payment and bounced the $1000.00 check. Then early this year they started foreclosure proceeding on us. Completely our fault for being behind. No arguments. My lawyer has been in regular contact with them as we were in the process of selling some other real estate which would allow us to catch up with Midland. So yesterday we received our payment and my lawyer asked Midland the amount needed to get current. They're reply was they're moving forward with the foreclosure and will not accept our money. My lawyer felt this was unheard of. I just feel Midland has no desire to work with anyone. I'd recommend anyone banking there to move out and move fast. Anyone considering a new bank do not consider this institution. They give banks the bad names many of them deserve.

Thanks for the enlightened rebuttal however depositing $1200 BEFORE writing a $1000 check is not kiting a check.

You admit right off the top you are kiting checks.  No wonder you're in foreclosure.  Whether the bank wants to accept your payment or move forward with the foreclosure is up to them entirely.  If they don't trust the borrower to be able to keep the loan current then they will foreclose.  The lender is under ZERO obligation to "work with" me, you or anybody.  No, I don't work for them.
