My mortgage was going into default while a portion of our income was lost. Midland Mortgage prepared a modification in the effort to "aide" us in fulfilling our obligation. This was an option offered by Midland, and accepted by us. Upon meeting our obligation, we had experienced an actual hardship, we lost all income in the household due to economical set-backs. My spouse, the "bread-winner" was laid-off off work. Now, according to the recent bill passed under President Obama, existing homeowners whom exerience such hardships qualify for several programs to assist homeowners in paying their mortgages and prevent them from foreclosures and losing their homes. We were set up with a third-party who did work in our favor and gave us the option for a mortgage reduction. The process was undergoing, and we had met all the criteria for this program. Our home was in foreclosure at this time, but we did get approved and the process was well in order. Midland learned of our hardship and "revoked" the original modification option once they learned about our hardship and continued the foreclosure proceedings upon proof and acknowledgement of the help from the government agency, and refused to postpone or stop the sale of our home. We had substantial proof that the government's agency could and did get us the help we needed and Midland sold our property anyway!!!! It was sold to MidFirst who already owned the mortgage from the beginning. The property was sold while our government agency was fully involved getting us the financing we needed. How is this action lawful? The foreclosure should have been stopped, and was not.
The market value is down and even so, we had a lot of equity, Midland Mortgage and MidFirst will profit largely from our total loss.
