My letter to Nissan USA Consumer Affairs outlining the issues

SUBJECT: 2008 Nissan 350z rear spoiler installation dispute with Midway Nissan Phoenix Arizona Shannon, Per our phone discussion on Thursday October 8, 2009 here is some additional information regarding the dispute claim of $161.99 with Midway Nissan for the incorrect installation of the Nissan OEM rear spoiler. The initial installation of the spoiler was back in May 2009 by Midway Nissan and was not acceptable; the center of the spoiler was bowing up in the center and the 3M tape that holds that portion was not binding to the vehicle and causing a bowing. One week later I took the car back to Midway Nissan to have them repair the installation and was initially told there was no issue and this is how all the 350z rear spoilers look, as I know other people with Nissan 350zs I know this to not be truthful.


Midway did however loosen the bolts on the spoiler to help with the bowing in the center but it was still apparent. Since the service manager told me this was as good as it would get I chose not to return the car to Midway Nissan for a third time and went to a specialty Nissan 350z shop to assist me with the repair. I needed to purchase a larger aftermarket spoiler for the car to cover up the mistakes and holes/dents (see pictures) that were made by the installation of the OEM spoiler by Midway Nissan. I did return to Midway Nissan one final time on Oct 7th 2009 to provide them an opportunity to refund my $161.99 installation charge one last time, they refused and now cited a bad OEM spoiler was installed and were willing to replace, since I already took the vehicle to them twice and now I was receiving a new story I gracefully declined their offer as I also had paid for a new spoiler and installation was already scheduled.


 With this letter you will also find the image from my credit card statement showing the $161.99 I disputed had removed and then was put back on the charge card I am unable to find the original invoice from Midway Nissan but I am sure that you can request that from Midway Nissan directly. I will however include an invoice from 350z motorsports for the cost of the replacement spoiler and installation charges as well as a statement from their technician as to the issues with the original OEM spoiler installation by Midway Nissan. Please take this opportunity to provide me my deserved refund of $161.99 for this incorrect installation performed by Midway Nissan Phoenix Arizona as well as the $403.00 for the OEM rear spoiler purchased from your part dept which you may have back as I not longer have a use for it.
