Midwest Golfscapes, LLC Dave Williams Large deposit made for synthetic turf and landscaping services which were not provided. Refund promised but not provided. Smithville Missouri

On 5/2/09, Dave Williams came to our home in Overland Park, KS to discuss "Waterless Grass" applications on our property. Williams had a sample of the synthetic turf which my husband had seen as part of a display at a store called Seasonal Concepts (we have no problem with them). At our house, Williams showed us numerous pictures of prior jobs he had done (supposedly) and gave us a brochure for Waterless Grass.

During the visit to our house on 5/2/09, it was agreed that Williams/Midwest Golfscapes would install a base, install Waterless Grass, river rock, and associated items needed to complete the project discussed in a small portion of our property. The bid was for $1362 which also included removal of existing plants and all debris. Williams asked for a deposit of $782 and we initially gave him our credit card number. Then Williams called us and asked for a check instead made payable to his brother, Phil Williams. We gave him a check in the amount of $782 on 5/5/09. We initially were told that the Waterless Grass would be received in about 2 weeks.

Over the next several weeks, there was one delay after another - rain, injured worker, he was short handed, etc., etc. Numerous phone calls were not answered, messages were left. The only way Williams would respond was by text message. Finally, in late June, Williams showed up one day to remove the existing plants and clean up the area. He also placed gravel where the old plants and bushes were removed. He was then supposed to come back to install the turf and river rock.

The work was never completed and now we have more of a mess than we had before. Again I made numerous unanswered phone calls. Finally, on 8/1/09 by text message, I requested a refund. This was nearly 3 full months after we reached an agreement. I received text message back stating we would receive a refund but that has not happened.

Here are some text messages I saved from Williams: 8/1/09 "U will b contactd on monday and refund will b issued! I will explain the circumstances to u when we talk!i believe u will have better understanding. Sorry!" - 8/5/09 "You will recieve it n next few days!" - 8/10/09 "U will have ive just been waitn 4 old partner to gve me money" - 8/14/09 "You should recv by monday!" - 8/18/09 "Ok i really thought u should have recd by now if u dont get today txt me and i will make arrangement with u.he told me he would send by fri."

Williams seems to have a pattern of empty promises. We are not the only people who have been fooled by him (I can elaborate on that separately). I have a copy of the brochure Williams gave us and the proposal/contract we agreed upon.

The business card Williams gave us says Midwest Golfscapes, LLC, phone numbers 816-522-5527 and 913-707-7713, address of 101 Bridgeport Drive, Smithville, MO 64089. Midwest Golfscapes, LLC is registered with the Missouri Secretary of State with Roy B. Boadwee as the registered agent at the same address. Boadwee is also listed as the 100% owner of the fictitious name registration of Midwest Golfscapes. The second phone number on the card is for Boadwee but he also has never returned my calls. I assume Boadwee is the former partner Williams referred to in his text messages.

In addition, I have been in touch with the manufacturer of "Waterless Grass" product and they also have not been paid by Midwest Golfscapes for their product and other items. They will not provide their product to Midwest Golfscapes/Dave Williams. Thus, any jobs being done for other customers are not being done with this product despite representations to the contrary. I have also been in touch with Seasonal Concepts (((redacted phone number))) and Trolleys restaurant (((redacted phone number))) and they too have had problems with this company/Dave Williams.
