Mr. Wiggins:

 

On or about Wednesday July 2, 2014, you accepted my car, a 1984 Mazda Rx7, for repair. You saw pictures of it before you requested to repair it. In fact, you begged for my car and business as you said your men “needed the work” and you could repair it.  My attorney’s office, State Farm and I requested on several occasions an estimate from you for the damage(s). You stated you were unable to assemble this estimate because you were so busy but you would “get to it tonight”.  Day after day we heard this same response. Finally, after approximately a week of requests from my attorney’s office, you finally submitted your estimate.

Approximately on or about July 10, 2014, I received a check from the insurance company, which at that time, you were paid in full (over $2500) for the amount you deemed required for repair my car.  You accompanied me to Regions Bank on Covington Pike n Bartlett, at which time you were paid in full, in cash as you requested as you did not have the funds to purchase the parts.. 

When you began repairing the car, I did not “hound” you as to when the car would be completed even though my rental car had been mandatorily returned to the rental car agency. You did come up with your own estimated completion dates, which was every Friday or Saturday afternoon in August and then September and October. Week after week you texted message me to denote the car would be ready for pick up that coming Friday or Saturday afternoon, but each of those dates came and went without the car’s completion.  At one date, you called me and told me you had to go to Arkansas to purchase another car to complete my car.  You stated you were leaving on one Monday but actually did not go until a week later because you did not have the funds to purchase said car despite I had recently paid you thousands of dollars.  To me, your shop looks like a Ponzi scheme.

Finally you called to say that the car would be ready tomorrow, October 22, 2014. I made arrangements to so I could be taken to your shop on the morning of Wednesday, October 22. I picked up the car and drove it, per your recommendation, for a test drive to see how it was functioning.  I drove the car to the nearest BP gas station on Covington Pike at Elmore Road (as the car mysteriously had gone from ¾ of a full tank to empty) and I then returned to your shop.  I told you the car was idling too high (1500 RPM and normal is 800-1000) and there were several other issues.  You told me to bring the car back the following week of October 30th and you would address the issues.  I have since brought the car back on three (3) occasions and you claimed you are too swamped to deal with my car.  Most recently,  returned the car on October 31 as per your request and you would complete my car. I returned at the prescribed time of 9 AM on October 31, and brought you a “punch list” of approximately 12 items and the key to my car, which you placed on you desk.  All I received on this date was a good tongue lashing and good unprovoked cussing from you!

One of several of the items that needed to be addressed was the push button lock on the driver’s side door as it went below door panel when depressed. I showed you that the door lock, when locked is below the top of the door panel, making it impossible to grasp and to unlock the door from inside once the door is locked. My concern was being trapped in a fiery crash and unable to exit the car.   You said there was “no adjustment” to the door lock knob.  I told you there was the plastic door lock twisted onto a screw assembly allowing the lock to project above the top of the door panel when properly installed.  Why you took this panel off is beyond me, as this side of the car was not damaged.

When I removed the door panel and tried to show you there was an adjustment, You threw up your bands refused to look at the locking assembly and just turned and walked off yelling profanity as you walked off,  “Get your sh* off my lot and I lost $500 on this deal.” (Videoed on my iphone )

In short, I have employed your services several times during the past 21 years.  You have rebuilt three (3) engines for me. I have spent thousands of dollars with you and your company. I have followed you from relocation to relocation because you were good. I have recommended you to many other Mazda owners.  Until this date I have been satisfied with your work even though you broke my cruise control and you told me you would make good on it.  Thus far, you have not replaced the cruise control like you said you would despite the fact I have asked you about it on a few occasions.  You have therefore rendered my cruise control inoperable.  I have just recently noticed when looking under the car that you or your employees have secured the  rubber dam under the car with tie wraps (zip ties) rather than obtaining the proper mounting bracket and securing the air dam with the proper bracket and screws as designed and prescribed by the manufacturer.  Once again, this shoddy type of repair is totally unacceptable and inexcusable. 

Until this point, I have bent over backwards trying to get my car repaired completely as you denoted you would.  You have refused to cooperate in every form and fashion.  I have rearranged my schedule on several occasions and inconvenienced others for their car, or a ride to/from your shop.  You now have failed to perform and refuse to complete the repairs.

 NOW, I am gravely concerned as the items that do not work, as many are safety issues, you are not willing to address or repair as follow:

  1. *HORN does not work, (driving a car in Memphis without a horn does not work).  I can hear power to the relay under the dash but the horn remains inoperable.)
  2.  Air conditioner compressor you replaced does not work, car does NOT cool off. System does not work,
  3. Bolt for right fender at door jam missing.
  4. *Oil pressure indicator in instrument cluster is NOT working.  (Critical for this car’s operation as oil is used to make the seal on the apex rotor.)
  5. *Temperature bulb on top of radiator has been disconnected.
  6. *Red warning “ADD COOLANT” light remains illuminated at all times on instrument cluster despite the coolant and reservoirs are full.
  7. *Right turn signal flashes rapidly denoting that the right turn signal system is not functioning properly.  When checked the front right two turn signals do not illuminated when selected.
  8. *Headlights are aiming down when selected. Beams need to be adjusted upward
  9. *Windshield wiper reservoir has been completely removed (stolen) from the car.
  10.  *Car idles at 1600-1700 RM. Normal is 800-1000 RPM.
  11.  Hood is not aligned properly on the Leading (front) edge of the car as well as the trailing edge.  Hood does not “seat” properly at latch.
  12. Something is rubbing in the front right wheel well that I cannot find.
  13. Paint is chipped at the leading edge of the hood from improper alignment and your team’s opening and closing.  You told me you would fix that as well.
  14. The hood just above the right head light is bent.
  15. Plastic on door pocket on driver’s side door panel is now broken.
  16. AIR DAM under front bumper has been secured with black tie wraps instead of the proper mounting bracket(s) and screws (or nuts and bolts)

By not addressing these safety (asterisks – bold faced) items you have placed me under undue stress and placed me in extreme danger.

 In closing, I have REPEATEDLY reached out to you on several occasions via your preferred method - texting and then via your phone (which has had a full mailbox for over a week) to have these repairs accomplished.  You refuse to answer your phone or return text or contact me via email.  All I have received in trying to accomplish is to have this list addressed and my car irepaired instead all I receive is a cussing and complete apathy for a job for which I have already paid in full.  I am hereby putting you on notice that I will be taking my car to reputable Mazda dealers in the local area to obtain estimates to complete the job for which I have already paid you. 

This letter will serve as an official instrument of communication denoting concerns and lack of performance and proper repair on your part.  With the 3 1/2 months you had the car, I would expect a better job than what your have returned to me.

In a Memphis, Tncourt of law .. a trial was held on Feb 10th and Degan lost his case against us!     Enough said !  If another word gets posted about me he will be in contempt of court and will go ''back"   To jail !!!!!

Chuck Degan Germantown TN 38139 October 31, 2014.  Mr. Mike Wiggins C/o Mike Wiggins Car Care Center 5075 Whitten Road Suite 103 Memphis, TN 38134.  DEMAND LETTER FOR REPAIRS/SERVICES FOR WHICH YOU HAVE BEEN PAID Sent via registered mail.  Mr. Wiggins: On or about Wednesday July 2, 2014, you accepted my car, a 1984 Mazda Rx7, for repair from an automobile accident. You saw pictures of my car before you begged to repair it. You repeatedly begged for my car and business as you said your men needed the work and you assured me you could repair it. My attorneys office, State Farm and I requested on several occasions an estimate from you for the damage(s). You stated you were unable to assemble this estimate because you were so busy but you would get to it tonight.

Day after day we heard this same response. Finally, after approximately a week of requests from my attorney's office, you finally submitted your estimate to State Farm. Approximately on or about August 11, 2014, I received a check from the insurance company, which at that time, you were paid in full (over $3000 in cash) for the amount you required for your services. You accompanied me to Regions Bank on Covington Pike in Bartlett, at which time you were paid in cash as you requested, as you did not have the funds to purchase needed parts. When you began repairing the car, I did not hound you as to when the car would be completed even though my rental car had been relinquished to the rental car agency. You did finally provide your own self-imposed completion dates. Week after week you text messaged me to denote the car would be ready for pick up that coming Friday or Saturday afternoon, but each of those dates came and went without the car's completion.

At one date, you called me and told me you had to go to Arkansas to purchase another car to complete my car. AIR DAM/ spoiler under front bumper has been secured with ONLY black tie wraps instead of the proper mounting bracket(s) and screws (or nuts and bolts). Over time, these straps will fail. Screws are missing from the driver side armrest, as it was NOT secured to the door. The black plastic cap to the right strut is missing! It was there when you opened the hood and appears in subsequent photographs! *The RIGHT headlight lamp does NOT open full as it lacks about one inch fully opening. In turn, the adjustment screw for the headlamp is below other sheet metal and is NOT accessible for any adjustment as the headlight beam is projected downward. *Car idles at 1600 RPM instead of 800-1000 per manual.

The car also runs rough and stall out when leaving from a stop, which it did, into do prior to the accident. Paint around windshield trim is splotchy an unattractive as your painter's tape pulled most of the trim pain off. Gasoline fuel door no longer pops open properly and this was not part of the accident. Drivers door was been apparently damaged at your shop and was repaired. The door was not part of the wreck nor was it damaged prior to the accident. The door now is wavy as I can see where it was damaged and repaired. There are large chips of paint missing from the driver's side of the car by the upper part of the door and the side window. There where NO paint chips in this area whe'n you accepted the car. Cruise control you had broken earlier, you stated you would repair but you did not! *The metal shield between the pop up headlights contains a minimum of 4 bolts where it attached inside the hood. There is only one bolt holding this sheet metal. Three bolts are missing. The wiring harness was supposed to go under the battery support bracket. You instead, have created a huge wire cluster and did not run it under the battery support assembly like it is supposed to be routed.

Yet again, you have take a tie wrap and attempted to secure the wiring harness illegally to another wire assembly that will wear through with time. *You also assured me the cracked windshield would be repaired and it was not. *Speedometer NO LONGER works. In closing, I have REPEATEDLY reached out to you on multiple occasions in person on October 21, 22, 28, and 31and also via your preferred method - texting - and then via your phone (which has had a full mailbox for over a week) In an attempted to get this situation amicably resolved Each time, despite an appointment had been made to see you and return the car; you told me you were too busy to look at it.

On October 31 at approximately 9:45 AM, you cursed me out about my car you had screwed up further. You have refused to answer your phone or return text or contact me via email. All I have received in trying to have this list addressed is a cussing and complete apathy for a job for which I have already paid in full. I am hereby putting you on notice that I have taken my car to reputable Mazda dealers in the area and have obtained as estimate to complete the job for which I have already paid you. I shall also take my car to a reputable body shop for completion of the job you have refused to accomplish and to fix where you have sabotaged my car! Gwatney Mazda has estimated over $3500.00 to trace all wiring and make it correct. I shall be holding you responsible for all missing parts and completion of all repairs.

This letter will serve as an official instrument of communication denoting concerns and lack of performance and proper repair on your part. With the 3 1/2 months you had the car, and 21 years of employing your services, I would expect a better job than what your have returned to me. Mr. Smith-

Mike Wiggins is the utmost professional in Mazda repairs and maintenance.  As a knowledgeable professional, he has been maintaining my current wrecked car since I purchased it as well as other previously owned Mazdas.

1. I have empathically stated since the onset of the destruction and your theft of my car from the Top Gun Tow (which you illegally towed my car to Copart Salvage Yard) lot on or about July 3rd that I was going to rebuild the car.  Thus far, there have been no funds distributed to Mr. Wiggins other than storage fees for said vehicle.

2.  Mr. Wiggins is in the process of securing parts for my 30-year-old vehicle for which your client destroyed by her careless.  Keep in mind, with a 30-year-old car, the parts may be available one minute and sold the next depending upon the highest bidder and part(s) availability.

3.  Mr. Wiggins has not been able to commence work on my car due to lack of funds distributed on your part.  So far, we are one month and three days (1 month & 3 days) into this process and NO PROGRESS.  This is not my first rodeo with State Farm.  I am hoping that I will not have to obtain legal representation for the repair of my car and that will remain and option as I am beginning to interview counsel.

4.  My car was completely repainted from front to rear, completely sanded to the metal and built up from the primer up. Your company only sees fit to have the car painted as to make it mismatch only on the area your client destroyed therefore greatly depreciating my antique restored car. This again is NOT acceptable.  

5.  At the present, Mr. Wiggins has only removed the front right fender of the car. I continue to be without my car.  Mr. Wiggins is not working on my car, as he cannot have one of his service bays tied up with a car he cannot work on due to no funds. In the mean time, I understand storage fees against State Farm continue to accrue daily.

6. I am hoping beyond all hope I do not have to seek legal representation to have State Farm do "the right thing".  I am, however, not ruling out legal representation as I saw how State Farm treated the clients of Hurricanes Rita and Katrina.

7.  Please notify me when you are serious and your company is ready to "do the right thing" and actively pursue the rebuilding of my car.

Here is something to consider as well... 1.My car is PERMANENTLY devalued as a totaled car.  
 
2. Mazda does NOT make sports cars any more thus making my car MORE valuable... No RX7's, no RX8's...
 
So $3516 is not acceptable and is an insult of an offer.
 
I have turned down $10,000 for this car. Like a 1957 Chevrolet, this car was certainly to increase in value as it had all original Mazda parts on it, had been completely repainted with original color paint and was show quality car...
 
Several attorneys denote i have a wonderful case and they are willing to handle it. 
 
In closing, if an attorney does take the case, i shall seek the entire $10,000 and associated costs.

EVIDENCE OF FRAUDULENT CUSTOMER REPORT

The issue is that 90 % of Mr Degan’s claims are false and can be documented.

 “ copies of proof will also be emailed to you along with photos”

Mr Degan brought his Rx7 to me to repair the right front wreck damage. He contacted

his insurance company and tried to fraudulently collect $10,000 from them saying the car

 was a collector item.  As I am sure you know insurance companies pay as per book value and

are governed by laws as to what they are required pay.  The insurance company determined

that the car was totaled and paid Mr. Degan  at approximately $3500. I agreed to repair

Mr. Degans RX7 for $2000.  Mr. Degan does not have a checking account and ask me to

cash the check and pay him the difference which was $1440 because he had no way to cash the check.

I wrote him a check for $1440 which he cashed

 A copy of the refund check is included in this response.

 Mr. Degan states in his complaint that he paid me (over $3000).

(That is his first false statement)    He did not state the “FACTS”

The insurance company asked if I could repair the car because Mr. Degan did not want

It totaled and threatened them with an attorney.  The insurance company finally exhausted

efforts to settle and turned to me to help as Mr. Degan would not take their calls.  I spent my time on the phone trying to help with communication between them which was not my job….

 I can provide the insurance adjusters name and phone number to  confirm this information. 

 This car is a 1985 model Rx7 and parts are hard to find.  We were able to find the body

parts for the car but when we removed the front body panels we found that the wiring

harness had a melted wire running inside the harness that caused the harness to be

non repairable.  I told Mr. Degan we had to find the harness and it would have to be cut

and spliced under the hood because there were no other options.  At this time I looked

on Craigslist and found a parts Rx7 in Little Rock Arkansas for $500. I took a day and drove

to Little Rock and bought the car … paid $500 plus my fuel  to get the car.. brought it

back and cut the harness  and put it in Mr. Degan’s  Rx7 which took many hours of labor.

 I explained to Mr. Degan that this was not part of the original price but since I had told

him I would do the job for $2000 then I would not expect him to pay any more money and

the price did “NOT” change but did not include the windshield and he accepted that.  We

finished the repair and painted the car.

 Mr. Degan picked the car up and there were “NO” additional charges.   Pics of the car after

Paint included.

 Mr. Degan called me the following week and told me he would be bringing the car in on

Wednesday for me to make some adjustments.  I told him that I would need him to drop

It off on Thursday and leave it thru Friday because of our work load and the items on his list.

He agreed.  He did not keep his appointment  and showed up on Friday and handed me a

list. I read it and told him that there were things on the list that was not from the wreck..

ie…  the oil sending unit was bad and he had made a previous complaint months before..

the interior parts had nothing to do with the wreck.  The legitimate complaints were the

horn inop , the right turn signal and a hood bolt broken, which were items that we would

have been happy to repair.  Mr. Degan somehow felt he had the right to schedule my

day for me and insist on me stopping what I was doing and address his needs.. after he

had missed the scheduled appointment the day before.  I returned to my office and was on my

computer doing an estimate for another customer and he came in and picked up his list and key

and said “ I’ll just call my attorney”    I did not respond as I was with another customer.  Mr. Degan

went out the back door.  When I finished my work  I went out into the shop area and saw Mr.

Degan out side the bay area working on his car.  I walked over and he had my tools and was

taking parts off the car that I purchased … and he was installing them on his car…

 I walked and and questioned him and asked what he was doing with my tools and told him

that he could not just take my parts.  He became angry and started shouting about some

“rip off website” .   At this point I took my tools and told him to get off my lot.  I had to threaten

to call the police.  This man was very aggressive and have since found out that his own mother

has an “ ORDER OF PROTECTION”  against him and he has recently served time in prison for stealing

a fire arm.   I have 2 witness’s that saw him take the parts and make threats. 

  I did a $3500 job for him for $2000, he received $1440 cash back and he has lied about the details and

we have copies of physical proof and witness’s . We are filing a restraining order against Mr. Degan this

week  and will be suing for defamation of character.  He has posted these false statements on Facebook

and we intend to sue Mr. Degan for damages.

  I sincerely hope you will not post the false information that Mr. Degan has provided and understand

this is a serious  legal offense to do so.  I have all documentation and witness’s to prove my case

which we will be doing so to stop this insanity.  I have served the Memphis area for over 30 years in the

Mazda business (Rx7 Heaven) and have thousands of satisfied customers.
