 We signed a contract with company to help us with a modification on the mortage. After 5 months they informed us, that nothing could be done! We understand, that nothing was guarntee.
 
In the contract, there is a clause that states: After efforts with lender does not offer a modification, client(us) will receive a refund of the amount paid in excess of 75% of the total modification fee. Client acknowledges that modification can take 1 to 6 months of work or more". We paid a total of $2700.
 
So now that we have asked to get our refund, they first denied it totally. But after I spoke to them and quoted what was on the contract, they sent us a letter, notifing us that we were only intitle to $675. I have spoken to Ron, the owner, and he is closed minded on the situation, to the point he told me today, that he didn't care if I took him to court. Please help! You have no idea the trouble we went through, to get the money, and then come to this! Thanks

Refund!!

Ron, states that he has sent us the refund check, but untill now, we are still waiting!!

I on the other hand have, proof that they did receive our refund letter, because I sent it via ups, and the package was signed and received on the 31 of August. The letter stated they (Mission) had 60 days to refund our money, but still waiting! I dont understand what is taking them so long to refund our money!

I guess what they they are going to keep, is not enough, so now they have the need to keep the refund too!!

Reading comprehension issue.

   I too read the original post and cannot figure out what they are complaining about.   Do they not understand what they wrote?

   In short, the return policy is that 25% is returned to the customer.  That means $675 (25% of $2700) should be returned, which is what the company agreed to return.    What is the OP asking for?

  Sometimes I feel sorry for companies that have to do business with folks like this.  It's a no win situation.

Mision Latina, Inc is a Foreclosure Postponement and Loan Modification marketing company with a very high rate of success.  EVERY MONTH we save homes for our clients, as well as complete loan modifications for our clients.  Most of the time, our clients save HUNDREDS of dollars on their monthly mortgage payment as a result of our efforts.  WE HAVE DOCUMENTED PROOF OF THE RESULTS WE GET FOR OUR CLIENTS.

As far as the Carias's case, this was on odd one, and we informed them from the beginning the chances of success would be low.  They decided to employ us anyway. Even though the mortgage and title to their home is in their son's name (Erick Maldonado, currently in New York) we first pursued a loan modification based on the Carias residing in the home and based
on their financials.  The lender would not approve any modification based soley on the parents.  The lender required the son's information and documentation as well; since HE is the one on the mortgage.  It took months to acquire all the necessary documentation from Erick that the lender required for further review.  Once we finally obtained all the documentation needed, it was apparent that Erick's income is quite high.  We sent everything into the lender as they
requested.  The lender denied the loan modification, mainly due to Erick's high income.  This was a tough case and we worked months on it, from every angle possible with the Carias's best interest at heart. 

We do not and cannot offer any guarantee of success.  This is spelled out very plainly in our Agreement for Services, in English and Spanish. 

The ultimate decision is always the Lender's.

We are sorry to hear the Carias's do not appreciate all the effort we put into their case. 

We are sorry to hear they do not understand the refund policy.  It's very simple, stated clearly in our Agreement for Services, and even correctly re-stated in the Complaint filed by the Carias's.  The Refund Policy states, "the client shall recieve a refund of the amount paid 'in excess' of 75% of the Loan Modification fees paid". 

The key words are: "the amount paid in excess of".  This means, if the Loan Modification fees are paid in full, then the refund is 25% of the total Loan Modification fee.  If only 75% of the total Loan Modification were paid, then NO refund is due, because NO monies were paid "in excess" of the 75% mark.

We are sorry the Carias's DO NOT UNDERSTAND THIS. We provided a refund to them based on this formula.
