He is not impartial and not interested in conducting a fair mediation. At our recent mediation with AAA Auto Club, Green spent the first 15 minutes extolling his virtues to my wife and our attorney who in fact has 20 years of insurance defense experience. Green then went on to skip any inquiry into what our position was or what the facts and circumstances were regarding the pending litigation. Instead, Green, who had obviously been well briefed by the insurance attorney, began to explain to us what was wrong with our case and what it would take for us to prove the damages claims. Green continuously felt the need to explain that litigation and going to trial were a bad idea. “You could lose and end up owing a lot of money...” In short, Green made a concerted effort to shoot down our case before any numbers were ever mentioned. We smiled and our attorney told him to stop blowing smoke, as did my wife. Green left the room with our reasonable demand purportedly to go meet with the other side and to provide our demand in the interest of the “mediation.” Green came back 15 minutes later and wanted to know if it was ok if the Insurance Adjuster came into the room to ask a few questions about how our life has changed since the accident. It was laughable since it was obvious that the adjuster merely wanted to see what kind of witnesses he would be looking at if the case went to trial… And Green was on board with him 100%.

That was it. No actual mediation or negotiation was held. No facts or relevant position was presented by the insurer, who merely sought to trick us into allowing the adjusted to ask us questions in person. Most attorneys would never allow such questioning by an adjuster. Green had no interest in seeing anything resolved and was clearing working for/with the insurer and their attorneys. In fact, the attorney for the insurer indicated in a recent letter that they had used Green on many occasions in the past. Now we know why.
