Money Tree, Inc. 1400 Madison St. Money Tree cashed a check that stated "CASH FRIDAY" without calling the writer of the check or bank and is now sueing the issuer for payment of a check that she stopped payment on in a timely manner Seattle, Washington

I wrote a check to a person for installing windows which I thought I won. I signed an entry at the Bainbridge Island 4th of July fair. With proof of a copy of my entry I belived I won replacement windows for my home. I wrote a check for the installation of the windows on a Wednesday evening and wrote on the check. 18 windows CASH FRIDAY. 

The person I was dealing with agreed to not cash the check until Friday. After leaving my home that evening, he cashed the check with Money Tree, Inc.  Money Tree never called me to verify that the check was real even though there was a note that said CASH FRIDAY. I followed up with the stories I was told by the window salesman and nothing matched up. The next business day morning, I stopped payment on the check and notified the person that I wrote the check to that I was stopping payment.

Money Tree gave the money to the scammer and is now insisting that I repay Money Tree. They never called to verify my check or my bank to find out  if there was funds or a stop payment.
If there was no reason to consider checking the background, I would be more sympathetic to their cause. However, my check clearly stated "CASH FRIDAY" and the person that cashed the check claims he had other checks that didn't clear but I was the only one that didn't fund it. Basically, Money Tree bullies innocent people to pay because they threaten that you will not only have to pay them but also their attorney fees.  This will also ruin a credit report on a reputable person.

Money Tree and other companies that make a HUGE FEE for cashing checks for people with really poor credit must be liable for using due diligence when cashing checks.

If the person spend 1 minute calling the number on my check, I would have told them not to cash the check. Now I have to pay over $1900 to a scammer. I'm not sure at this time who I'm being scammed by. I believe it is Money Tree because I stopped the 1st scam with a Stop PaYment.

   It doesn't matter what you wrote on the check.    A check is negotiable as soon as you write it.   Writing a check without funds to back it is illegal in most jurisdictions.   Post dating or writing "Cash Friday" does not get around this requirement.    Money Tree was well within their rights to cash the check.

  If it was a valid check that you wrote, they did their due diligence.    You, on the other hand, broke the rules (and possibly your local bad check laws).  If you lived in my county, the check cashing place would probably give the check to the county attorney for prosecution.

  You seem to think that you make the rules.   The real world doesn't work that way.   Your check is your signed promise to pay.   You don't get to go back on that with a phone call.    You do have the option of stopping payment, but you are still obligated to make good on your signed promise to pay.   If you don't, it's the same as if you had written a rubber check.   

  If you think the window installer scammed you, you'll have to take that up with them (likely in a small claims court).   The check cashing place, on the other hand, has a bogus check with your signature on it.  No doubt they have an entirely different opinion on who the scammer is.

What day was the check presented to your bank? You wrote the check Wednesday. Placed the stop on Thursday. Most banks won't guarantee the stop until the next business day which would have been Friday. So if the check was presented to your bank on Thursday and the bank stopped it you've got a pretty good bank.

As far as the "Cash Friday" notation, this is the same as post dating a check. The check is payable as soon as you sign it and hand it to the company. It the company holds it until Friday or the post date it's just a courtesy they extended. It's not enforceable. I don't think Money Tree or any business similar is going to call the signer or the bank to verify a check. Most banks won't verify funds without the account holder on the phone. And even then, a verification just says the funds are/are not available right now. It doesn't guarantee the check will be honored.

You might want to see if your area has an "ask a lawyer" or similar program to see what the law says about you having to pay for the check. Since you did receive the windows, it might be difficult to support the stop in a court of law. I hope this works out for you.
