Banks that had closed commercial operations in 2006,07 & 08 were allowed to continue to do business because Mortgage Electronic Registration Systems Inc. separated the mortgage from the deed and did not record the holder of the mortgage. I have proof that GMAC, Homecoming Financial, Wachovia, World Savings, MortgageIt, and BrokerSource Mortgage had closed commercial operations at the time of the transactions on my property. All of these companies were on title to my property at the same time. All of these companies are on a list of 1,500 companies that had closed commercial offices in 06,07, & 08. This was allowed to happen. In 2009 I filed a complaint with the Office of Thrift Supervision (file#0104262009) which was responded to by Mr. Bowman. His response was "What do you want us to do?". GMAC has become Ally Bank. Wachovia was acquired by Wells Fargo and MortgageIt(formerly a subsidiary of Deautch of Germany) was under investigation for fraud at the time of the "Trustee Sale" on my property. BrokerSource was a subsidiary of GMAC. At the "Trustee Sale", the name of the lender on the documentation was changed to reflect a company that was in business at the time. The person being foreclosed has no voice in California once the case goes to court. The Treasurer for the City and County of San Francisco has done the first audit of foreclosure sales in the state. He found that 85% of the actions taken between 2009 and 20011 were illegal. Judge Robert Grossman has ruled that MERS business practices are and have been unlawful.67 million plus mortgages have not been recorded on the county records until the properties were in foreclosure. that's how the dummy businesses were able to collect fees(working the gap). All MERS loans should be void and those denied loan modifications or who have lost property, if MERS was involved they should get the deed free and clear.
