Eric W. Butler came to my door early August 2010 - recommended by a friend - I was doing my own modification with Chase for 4 months - he said give me $1300 - he will take care of modification and be my back up plan.   I wrote a check and gave to him made out to "Mortgage Modifiers T.R."  The canceled check was signed Eric Butler on the back, Bank of America, his bank.

He took all of my original paperwork (bank statements, tax returns, etc.,) promised to get it back to me in 48 hours with signed contract for his services.

After that nothing - I tried to call him to get a phone number off of my paperwork - that took over a week and dozen phone calls.

Then tried to get original paperwork back as Chase was asking for more documents - that took over 2 weeks.  He gave me a business card that he no longer worked there.  Said he was in hospital for knee surgery and couldn't check his messages.  This guy is in his late 20's - early 30's.  Said he sent it FedEx - a week later no paperwork.  No FedEx.

The trust was gone at this point - asked for my money back September 10 - no money back as of today October 6, 2010  

DO NOT GIVE HIM YOUR MONEY - LOAN MODIFICATION CONSULTANTS HAVE TO BE REGISTERED WITH THE ATTORNEY GENERAL AND PUT UP A $100,00 BOND.

Not only that but as of today - I know one other person he took thousands from and has not returned their money either.   RIP-OFF

First and foremost i will not waste anyones time rambling on and on in response to an inaccurate accounting of this transaction. I will keep my response direct, factual, and professional. Diane signed up for my processing services in August 2010. As clearly stated in the contract she signed, my scope of services are to assist in the processing an application for loan modification services, not promising a specific result. As also stated in said contract, services are also to be delivered within 30 (thirty) days of enrollment. Less than three weeks after signing up, Diane demanded a refund of all fees deposited, before an appropriate amount of time had been legitimately allowed. All of her confidential documents were returned to her in person within 10 days of her demand for cancellation. She was advised that if she wished for her funds to be deposited, she needed to submit a written request, and the refund would be expedited. After having failed to do so, she immediately went to the Orange County District Attorney's office and filed criminal charges for the following;
Felony Grand Theft 
Felony Unlawful Contract
Misdemeanor Unlawful Advance Fee
Felony Failure To Properly Register As A foreclosure Consultant
amongst others.... As it ended up, The charges were not substantiated by the District Attorney's office in court, and her refund was given. Paid in full by me, Eric Butler. Unfortunately, Diane felt as if a legal route was the way to go. Had she approached me in a professional forum, and treated me with even an ounce of respect as an individual, or professional, it would have happened sooner. She was made whole, and the services would have been rendered, had she allowed an appropriate amount of time as stipulated clearly in my contract. I have processed hundreds of these cases as a consultant, and would be happy to provide an ample amount of character and professional references to back this up. However i feel naming specific individuals over the internet is horribly unprofessional, so anyone that would like to email me at ericbproductions@aol.com with a request for proof of these satisfied clients, i would be happy to forward their contact information with their permission. 
As a word to the wise.... An individual consultant that "processes applications" cannot be governed by the Dept. Of Real Estate, or the State Bar of California. Only licensed Real Estate Professionals are required to register and file an insurance bond with the state. I would like to be clear that i am neither a licensee, nor am i an attorney. I am simply a consultant that has attained the necessary expertise to know what properties and borrowers would be approvable by the major mortgage lenders under the Making Home Affordable Program for the State Of California. I do not negotiate on anyones behalf. If you qualify, i know how to apply on your behalf. Diane amongst hundreds of others, have come across my name by referral only, i do not solicit myself and never have. So i ask the question how they ever knew i was capable? Because i had helped many others in need, those clients felt i provided an invaluable service to them, and passed my info along. I have and will never seek predatory, or aggressive marketing strategies as many others do in efforts to take money from anyone i cannot help. 
In closing, anyone that decides they need my help may request termination of my contract at anytime, and their refund request will be processed in a professional manner. Had Diane done this, she could have saved not only her own time, but many other people's time, that could have absolutely spent that time helping people that actually needed it.
