Musictoday.Com Ripoff Misrepresented Product Receipt Date Bait and Switch Expedited Shipping Offer Crozet Virginia

On 5/14/2007 I responded to a promotion that was available via my Police Fan Club web site membership. The web site includes a link to a fan club storefront powered by Musicatoday.com.

The items I ordered from the store were a T-shirt and Pin combo to celebrate the Police tour opening night. The text of the product included the line : "Your card will be charged at the time you order, but your order will ship on or around May 25, 2007. "

I responded to an offer that allowed me to pay an additional shipping amount in order to be guaranteed that I would receive this item "on the release date". The only release date listed anywhere with respect to this item was the above-referenced warehouse release date of the 25th.

I received an email on the 24th with a tracking number, and checked the status only to find out that the item is not going to be delivered to me until the 29th. Musictoday.com is refusing to refund the extra $18.45 I paid in order to be guaranteed receipt on release date. The "on or around May 25th" made it clear that the item could in fact be shipped for receipt on the 25th.. it was "on or around", not "on or after".

I have screen prints from my order process, and there is no mention of any date other than the 25th. Musictoday.com is now claiming that the release date for the Shirt is the 29th, and that that was listed in the product details at the time of my order. My printouts show otherwise.
