- “A happy customer tells a friend; an unhappy customer tells the world”
- The internet has magnified the adage with a greater number of people hearing from the unhappy/dissatisfied customer (who can effectively complain on websites).
Caveat emptor (pron.: /ËkæviËÉËt ËÉmptÉr/) is Latin for "Let the buyer beware"[1] (from caveat, "may he beware", the subjunctive of cavere, "to beware" + emptor, "buyer").
Dear Joe Schirripa- Manager Naromax Billing Department:
I appreciate, your Tuesday, March 12, 2013 @ 11:09AM email response to me, re: Naromax’s incredibly inappropriate and abusive sales practices. I do want the forty- nine ($49.00) credit back to my MasterCard you have on file with Naromax’s Billing Department. Please make sure, you also remove me, from Naromax’s “Watch-of-the Month” Club. I do not want any more watches sent to me-thank you.
You wrote: “…, in the spirit of compromise we are willing to offer a partial refund of $49. My MasterCard was charged a total of one hundred and fifty-two ($152.00) dollars. I am only receiving a credit of forty-nine ($49.00), you get to keep one hundred and three dollars and ninety-nine cents ($103.99.) You keep sixty-eight (68%) percent of this business transaction; I have lost this money. I get a measly thirty-two percent (32%) of the money. Call me overly-analytical, but that doesn’t work out to well for me.
I mailed a package to Naromax on Wednesday, March 13, 2013 with U.S Post Service Confirmation Receipt # 0309 18300 00010044605628 to Naromax, 1200 South Brand Boulevard- Suite 154, Glendale, CA 91204. The package envelope included Omax Watch Bar Code # 00HBJ843PH02. I do not want any merchandise, in my home, from Naromax.
I am wondering why you are not able to just put out the exact price of the watch to your potential internet buyers. I believe you wouldn’t be able to sell too many of these watches. So, you stoop to “Terms and Conditions,” which only benefit Naromax. I think this is very narrow-minded and extremely poor business practices.
After reading the complaints, it appears you are doing this modus operandi on many people. You ensnare them in your game and continue to take money out of their Visa or MasterCard accounts.
Please be assured, I plan on contacting as many consumer organizations as I can to warn people of the internet scam you are perpetrating on the consumer population. It’s abusive and wrong. I think I need to start with BBB in Glendale, CA; I need to investigate what other Consumer Protection Agencies might be able to come to your office and make a visit. They then could, review your policies and the methods; you are using to obtain watch orders on the internet. I am wondering it Small Claims Court is an option for me? If you don’t immediately refund the forty-nine ($49.00) dollars to my MasterCard account, I will investigate this option. It’s definitely worth my time and effort.
I first ordered your five dollars ($5.00) watch offer on January 18, 2013. After I called my MasterCard Company Dispute Department, I was told that I had agreed to a “14 Day Trial Period.” During that period, I needed to return the watch, or else I would then be charged another ninety-eight dollars ($98.00). You shipped the Omax Watch out on January 19, 2013- USPS Tracking # 9400 1102 0082 9637 9754 74. It arrived in San Francisco, CA on January 22, 2013.
What surprised me was, that there was no invoice or “Return Policy Information” included in the packing envelope. It was only the watch- why? Did you suggest printing out the agreement before I left your internet site?
To make matters even worse, the watch slipped off my wrist, as the clasp is difficult to use and manipulate. It landed on the watch face and the glass shattered into three (3) pieces. I still have it, I can return that watch to you too. You could send it back to the manufacturer to show them the shoddy workmen ship, which goes into the manufacturing and quality of this watch. I now have a one hundred and four dollars ($104.00) piece of garbage.
I was stunned to receive another Omax XTS001, that’s my best guess. You mailed it out on March 4, 2013- USPS Tracking # 9400 1102 0082 9687 7316 00. The watch was delivered on March 6, 2013. What is this, the fruit of the month club? Would you continually send a new watch to me every five (5) to six (6) weeks? Plus my MasterCard was charged forty-nine ($49.00) more. How could the price of this watch drop so dramatically?
What I learned, from this whole incident, is that I will never order a product which “sounds too good to be true!” Because it’s not! Your business practices are very, very dubious and disturbing. Be honest, be decent, and be kind to your customers, it will pay off in recommendations and further purchases. You get neither.
Please immediately credit my MasterCard for forty-nine ($49.00); plus do not send me anymore Omax watches from the Naromax Company.
I appreciate the time you took reading this letter. If you have any questions, comments, or need for clarification, please contact at: (((REDACTED)))

Yours sincerely,

Dear Mr. XXX,
We regret that you overlooked the terms and conditions which were provided to you on your order page (www.Naromax.com/order). We ask that you take a moment to review this page and note that the offer details are described in full detail about an inch to the left of the fields which you input your payment information into.
Additionally, the terms are listed in their entirety at the bottom of this page, followed by a “check box” in which we ask for your binding agreement that you understand the terms and conditions. Please note that our order system cannot issue you any orders unless this box has been checked as part of the order process. Most of our customers do, in fact, either cancel their account and return the product within the 14 day period, or go on to receive our product on a monthly basis.
Although you did not cancel your account within the allowed time period, in the spirit of compromise we are willing to offer a partial refund of $49. If you agree to this compromise, please respond to this e-mail stating so, and you will promptly have the above amount transferred back onto the card you have on file with us.
Sincerely,
Joe Schirripa
