Received a notice from this credit agency that I owe $112.83 on a hollywood video account for the company that closed down last year. I am quite certain that these are fraudulent charges since I purchased DVD's from them while they were going out of business and specifically asked If I had any late charges as to avoid such a situation. I plan to dispute this by registered mail and would love to sue them if they do not drop it. If there are any people involved in a class action against this organization I would be glad to be included and may be contacted. Of course just as a precaution I closed down my Blockbuster account and got a printout from their register showing 0 owed. Sorry for Blockbuster but I have to protect myself at this point as they are likely next to go and who knows who in that organization would have the brilliant idea of scamming people who can't prove in a court of law when they dropped off a movie rental.

An interesting item on this scam on msnbc news. funny how similar his charges are to mine.

“Any creditor has the right to lawfully collect a legitimate debt,” Bullock says. “But in doing so the agency can’t demand unlawful collection fees and must give that consumer fair notice of the claimed debt and a chance to pay it or dispute it. None of that happened here.”

Tom Huff, a retired University of Montana professor, found out about the NCS collection notice in his credit file when he and his wife went to refinance their home in Missoula. The banker said there was a problem with one of their credit reports.

It turned out to be a claim for $117 for late fees from two Hollywood Video rentals. When Huff challenged the charge, the NCS representative on thephoneasked if he could prove he had returned the DVDs?

“Nobody has proof,” he said. “You drop them in the slot.”
