I am a partner in a small business. One day in Feb 2009, I got a call to see if I wanted to save money on my credit card processing. As a small business owner trying to control costs, I agreed to speak with Timothy (Tim) Boyd.

I was told about specific rates and processing fees for the credit card processing service that Tim was offering. Tim used a spreadsheet where he plugged in numbers and showed me potential savings of $300-$400 a month. That sounded good, but in reality was a complete fraud.

Also, I was told that there are no cancellation charges and equipment fees other than a monthly fee of $5.

Here is the problem. Everything on the equipment side was fine. I get my first test statement and notice that the fees and charges are higher than what I was promised. Instead of saving money I was going to spend more per month on credit card processing. This was a shock to me and so I try to cancel the service, thinking I have no cancellation fees or penalties. This is ABSOLUTELY wrong.

The application I signed has a very small fine print that says you are signing up for the "standard" terms and conditions.

Those standard terms and conditions is basically a contract for 3 years, that automatically renews. Also, if you terminate the agreement early you will be charged a $495 fee.

Nowhere in my signed application does it state that. Also, repeated phone calls to Tim Boyd and National Merchant Solutions kept saying that they do not have a cancellation fee. This statement is true.

The way NMS works is they resell RBS Worldpay credit processing service. When you signup you are signing up with RBS Worldpay, not NMS. The terms and conditions are of RBS Worldpay. This is a dishonest way of doing business and you cannot get out of the contract.

This is a FRAUD and please do not ever do business with National Merchant solutions.
