I owe some money to Direct TV...I was out of work for awhile, and have since moved to a much smaller apt to save money. Direct tv turned me over to Nationwide Collections.

The guy who called me was so rude-I told him I would have to wait 2 wks until my next payday before I could send in the 174.00. This man started out by suggesting that I write a post-dated check. When I advised him that I do not have a checking account, he suggested that I call a family member and ask him/her to post-date a check for me.

I stood my ground, and continued to inform him that NO, I will NOT ask my friends or family for money, I told him I will pay in 2 weeks. He PREDICTED that when 2 wks rolls around I will probably just "blow the money on groceries or something" I was furious. Still, I was not rude...then he asked for a phone # of a friend do he could do a 3 way call w/me and ask for money. He finally ended by stating that he would tell his "client" I REFUSED to ever pay the bill. NOT TRUE, NOT WHAT I TOLD HIM!!!

I will pay the bill like I said I would, then I'm getting cable.

No debt collector may solicit a post dated check. That is a clear violation of the FDCPA.

And any statement that degrades the debtor is also illegal.

Go online and file the FTC complaint, then send a copy of it along with your cease communications request. Certified mail/RRR.

Don't file suit yet - you don't have a case (yet)

There are a couple of things you nee dto know about filing suit:

1. You need to have a case. In this instance you don't (yet). Suggesting you beg borrow or steal, and even being demeaning, is NOT a FDCPA violation.

2. Arizona is a 1-party state, meaning you can tape the phone calls without even telling the collector. So, buy a tape recorder and start getting the violations on tape.

3. There are several Message Boards on the web that are specifically designed to help you get the information you need to get this jerk off your back. I own one of them - it's called Debtorboards. My board has an attorney on it who helps people with lawsuit preparation (and he's an ARIZONA attorney - in Tucson..... hint hint hint....

Call the company back and get a mailing address. Send a letter certified mail return receipt requested stating that you demand that they cease and desist all further communications with you either by phone or mail except to advise either that they are discontinuing collection of the debt, or as otherwise required in legal proceedings. Pay your bill when you get paid in 2 weeks. If they contact you again, then you file suit for a violation of the Fair Debt Collection Practices act. This guy was acting very unscrupulously, and while his business has a right to collect the debt you owe, you also have rights as to what means they are able to employ to collect the debt. Don't let them push you around.
