I have recently received a letter from Nelson and Watson about a debt. I have broken my neck and have poor finances since Jan, 2003. I have not been able to pay and they called this evening and threatened to TAKE ME TO COURT AND SUE AND OAY THEM court costs, about $5,000.00 and the outstanding debt, $1100.00 and 687.00 interest. NOW.

I have repeatedly asked for some records of this debt as I was/am a ward of the state since 2003, and could only possibly make paymnets but I do not know about this debt.
The person was extremely rude and ignoreant and would not ever giver her name.
When I called back, on a different number, the same ignorant person answered the phone. After some, no many words i was put on with a 'supervisor', who stated that she is only doinf legal issues and I OWE thw mony and MUST pay NOW, or I will be sued an dow ALL COSTS>
I have tried to find out something s=about this debt and was told, "you made it and WILL PAY IT"

After a few calls, I was told that I could pay right now and a few calls later I have been told that I could pay it all by September 5, 2008 the latest, with half to be paid by Aug 3, 2008.

Without even telling me anyting close or a way to contact PALISIDE ACWUISITIONS, with who they bought he losn from, or are legal reps for, different stories, I am lost and hope that I can find help from somewhere.

The statute of limitations for credit card debt in NY state is six years....so if you defaulted in 2003, it would barely be within the statute of limitations....This means that they have the ability to take legal action against you....HOWEVER, if you are on SSDI/SSI....they can't touch your checks as SSI/SSDI cannot be garnished.

Send them a letter via Certified Mail + Return Receipt stating:

Per the Fair Debt Collection Practices Act, I am requesting written validation of this alleged debt

DO NOT sign your name on this letter...they could pull your signature off and put it on forged documents.

You have important rights under a federal law called the Fair Debt Collection Practices Act. You have the right to request written validation of the debt. Debt collectors cannot take your firstborn child, nor can they send the police to your residence to have your arrested for not paying them. Debt collectors cannot be abusive and they cannot pretend to be (or work for) attorneys when this is not the case. Anytime a debt collector threatens legal action, per the Fair Debt Collection Practices Act, you have the right to speak with their [alleged] attorney. Request to know the attorney's full name and his/her license # in the state bar association.


NEVER debt collectors your checking account # for payment...they can take out WAY more that you authorized....possibly leading to tons of bounced check fees.
