NG&G Failure to pay for agreed upon work Lincoln Rhode Island

    I own a small remodeling/handyman services company located in Upper Marlboro, Md.  From time to time I am contacted by NG&G services to perform repair maintenance on their network of retail stores.  I started to notice that the pay for these services were slow and they often expect contractors to go out to the site to asses damages or repairs for no compensation, so I was reluctant to accept a job to repair work at the local JC Penny store.

  I was contacted several times by Luis Montalvo from NG&G services asking if I would repair the carpet in the "Call it Spring" shoe section of the store.  I completed the work on September 30, 2013 and emailed the signed Work Order by store manager Paulette Jennings to NG&G along with the invoice for $350 on October 4, 2013.  

It' Christmas day.  I haven't been paid.  I've been told everything from JC Penny hasn't paid yet to the payment is being processed.  I somehow find it hard to believe JC Penny's can't pay $350.00 for repair work signed and approved by their store manager!

    On August 13,2013 I was contacted by Estimator/CSR Luis Montalvo asking if I would drive to Value City Furniture In a neighboring county (Charles County) to assess a pair of out of service water fountains.  I replied "Time is money and I just can't drive around as your local eyes and ears.  That service you have to pay for.  Luis agreed and sent work order P739112 noting that they would agree to pay my travel and time expense of $350.00.  I then visited the site where I was informed several techs had already visited the site in the past and never came back and the fountains were out of service for several years. Hmmm

     I sent a proposal to remove the outdated Elkay fountains, cut the drywall/remove and cap off affected plumbing and electrical lines, replace and repair drywall and paint entire area for a sum of $932.00.  Luis Montalvo agreed to the terms, sent an updated work stating so and my company performed the work.

It's Christmas Day. I haven't been paid. 

Again I've been given every excuse under sun.  Finally after contacting the so called vendor relations department on December 13, 2013 complaining about not beint paid for either work order D754788 and P739112 while being effectively ignored by accounts payable, Luis Montalvo shot me a quick email stating "There was an issue our end but I submitted this asap. I will confirm and let you know when to expect payment.

December 23, 2013 still no response so I call NG&G again the rep said no one's here to really help you today.

To Date NG&G is overdue on $1,282.00 which they agreed to pay but just won't.  I even visited the Value City Furniture store on Smallwood Drive in Charles County Maryland.  To my suprise they are completely remodeling the whole store with beautiful new carpet, paint and fixtures.  "Does this sound like a client who hasn't paid"?

December 24, 2013 Merry Christmas! I received an envelope from NG&G services.  However inside there no check but letter stating that they would reduce my invoice by $200.00 because they don't feel they should pay  because the job actually didn't take as long as they thought!  Merry Frickin Christmas

This is just a short summary of the calls, emails and correspondences I've had over the past 90 days.  Still no check!
